90.—(1) A person who is guilty of an offence under—
(a)regulation 89(1)(a)(xi);
(b)regulation 89(1)(a)(xxi); or
(c)regulation 89(3)(a) by reason of a contravention of regulation 31(1)(b),
is liable on summary conviction to a fine not exceeding level 5 on the standard scale.
(2) A person who is guilty of any other offence under regulation 89 is liable—
(a)on summary conviction to a fine not exceeding the statutory maximum;
(b)on conviction on indictment to a fine.
