The category of use in section 76(2)(h) of the Act does not include filling or maintaining an ornamental fountain which is in or near a fish-pond and whose purpose is to supply sufficient oxygen to the water in the pond in order to keep the fish healthy.

In that section, “ornamental fountain” includes a cascade or any other display of moving water.
