33.20. Where an application is pending for a variation of—
(a)a financial order;
(b)an order under section 27 of the 1973 Act; or
(c)an order under Part 9 of Schedule 5 to the 2004 Act,
no warrant of execution may be issued to enforce payment of any sum due under those orders, except with the permission of the district judge.
33.21. Where a warrant of execution has been issued to enforce an order made in family proceedings pending in the principal registry which are treated as pending in a designated county court, the goods and chattels against which the warrant has been issued must, wherever they are located, be treated for the purposes of section 103 of the County Courts Act 1984(1) as being out of the jurisdiction of the principal registry.
Section 103 has been amended by section 74(1) and (3) and 125(2) and paragraph 16 of Schedule 17 to the Courts and Legal Services Act 1990 and section 10 of and paragraph 2(2) of Schedule 2 to the Civil Procedure Act 1997.
