The Secretary of State makes the following Order in exercise of the powers conferred by section 33(1) of the Crime and Security Act 2010(1).

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Crime and Security Act 2010 (Domestic Violence: Pilot Schemes) Order 2011, and shall come into force on 30th June 2011.

(2) In this Order, “the Act” means the Crime and Security Act 2010.

Pilot Schemes

2.  Sections 24 to 30 of the Act (domestic violence) shall come into force to the extent provided in article 3, for a period of 12 months from 30th June 2011 ending on 29th June 2012, so that the Secretary of State may assess the effectiveness of these provisions.

3.  Sections 24 to 30 of the Act (domestic violence) shall come into force in the following areas:

(a)in the Greater Manchester police area, the Policing Divisions known as Oldham Division, South Manchester Division and the Metropolitan Division(2);

(b)in the West Mercia police area, the Territorial Policing Unit known as South Worcestershire(3); and

(c)the Wiltshire police area(4).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force sections 24 to 30 of the Crime and Security Act 2010 on 30th June 2011 for 12 months for the purpose of assessing the effectiveness of the provisions by way of regional pilots.

Those sections will only come into force for the purposes of three regional pilots which will take place in three policing divisions in Greater Manchester, the entire police force area of Wiltshire and one territorial policing unit in West Mercia.

These provisions include the power for an authorising officer to issue a domestic violence protection notice to an alleged perpetrator of domestic violence, and the power for a magistrates’ court, on application made by complaint by a constable, to make a domestic violence protection order.
