The Animal Welfare (Code of Practice for the Welfare of Gamebirds Reared for Sporting Purposes) (Appointed Day) (England) Order 2011

The Secretary of State has in accordance with section 15(1) of the Animal Welfare Act 2006(1) prepared a draft of the Code of Practice for the Welfare of Gamebirds Reared for Sporting Purposes and consulted about the draft such persons appearing to the Secretary of State to represent any interests concerned as the Secretary of State considers appropriate, and considered the representations made by such persons.

The Secretary of State laid a copy of the draft with such modifications as the Secretary of State thought fit before Parliament under section 15(2) of that Act.

Neither House of Parliament has, within the forty day period provided for in section 15(3) and (4) of that Act, resolved not to approve the draft laid, and the Secretary of State has issued the code in the form of the draft.

The Secretary of State, in exercise of the power conferred by section 15(5) of that Act, makes the following Order.

Citation and application

1.  This Order—

(a)may be cited as the Animal Welfare (Code of Practice for the Welfare of Gamebirds Reared for Sporting Purposes) (Appointed Day) (England) Order 2011; and

(b)applies in England.

Appointed Day

2.  The appointed day on which the Code of Practice for the Welfare of Gamebirds Reared for Sporting Purposes(2) comes into force is 31st January 2011.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order sets 31st January 2011 as the appointed day when the Code of Practice for the Welfare of Gamebirds Reared for Sporting Purposes comes into force.

An Impact Assessment has been prepared and placed in the library of each House of Parliament and is available on the Defra website, www.defra.gov.uk. The Code of Practice is also available on the Defra website.
