The Secretary of State—

(a)in exercise of powers conferred by section 64(1), (2), (3) and (5) of the Road Traffic Regulation Act 1984(1) (“the 1984 Act”), makes the regulations contained in Part 1 of this instrument; and

(b)in exercise of powers conferred by sections 65(1) and 85(2) of the 1984 Act(2), gives the general directions contained in Part 2 of this instrument.

In accordance with article 4 of, and Schedule 3 to, the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc) Order 1999(3), the Secretary of State has consulted with the Scottish Ministers.

In relation to the regulations contained in Part 1 of this instrument, the Secretary of State has, in accordance with section 134(2) of the 1984 Act, consulted with such representative organisations as the Secretary of State thought fit.

PART 1The Traffic Signs (Amendment) (No. 2) Regulations 2011

Citation, commencement and interpretation

1.—(1) These regulations—

(a)may be cited as the Traffic Signs (Amendment) (No. 2) Regulations 2011;

(b)together with the general directions contained in Part 2 of this instrument, may be cited as the Traffic Signs (Amendment) (No. 2) Regulations and General Directions 2011; and

(c)come into force on 30th January 2012.

(2) In these regulations, “the 2002 regulations” means the Traffic Signs Regulations 2002(4).

Preliminary

2.  The 2002 regulations are amended as follows.

Amendment of regulation 4

3.—(1) Regulation 4 (interpretation—general) is amended as follows.

(2) After the definition of “cycle track”, insert—

“designated lane” means a traffic lane reserved, by an order under section 1 or 6 of the 1984 Act (traffic regulation orders and orders similar to traffic regulation orders), for use by such class of vehicular traffic as is, by the order, specified for the purpose of that reservation;.

(3) After the definition of “enactment”, insert—

“enforcement agency”, in relation to a sign, means a successor (whether immediate or not) of the Vehicle and Operator Services Agency where that successor is responsible for any enforcement to which the sign relates;.

(4) In the definition of “equestrian crossing”, in paragraph (b)(ii), after “diagram 4003.4” insert “(whether or not placed with the signal shown in diagram 4003.4A)”.

(5) In the definition of “maximum laden weight”, for “section 41(8)” substitute “section 41(7)”.

(6) In the definition of “signal-controlled pedestrian facility”, in paragraph (c)(ii), after “diagram 4003.1” insert “(whether or not placed with the signal shown in diagram 4003.1A)”.

(7) In the definition of “Toucan crossing”, in paragraph (b)(ii), after “diagram 4003.7” insert “(whether or not placed with the signal shown in diagram 4003.7A)”.

(8) After the definition of “traffic lane”, insert—

“traffic officer” has the meaning given in section 100(5) of the 1984 Act;.

Amendment of regulation 6

4.  In regulation 6 (interpretation of references), in paragraph (f), for “prohibition or speed limit” in both places where it occurs, substitute “prohibition, speed limit or advised maximum speed”.

Amendment of regulation 10

5.  In regulation 10 (application of section 36 of the Road Traffic Act 1988 to signs and disqualification for offences), in paragraph (1)(f), for “1043, 1044 and” substitute “1043, 1044, 1044.1, 1044.2 and”.

Amendment of regulation 12

6.  In regulation 12 (variations of dimensions), in paragraph (4), after “1001.2,” insert “1001.2A,”.

Amendment of regulation 13

7.  In regulation 13 (proportions and form of letters, numerals, symbols and other characters)—

Amendment of regulation 22

10.  In regulation 22 (buses)—

(a)in paragraph (1), for “In the signs shown in” substitute “In Part I of Schedule 19 and in the signs shown in”; and

(b)in paragraph (2), for “in the signs referred to in paragraph (1)” substitute “in Part I of Schedule 19 and in the signs referred to in paragraph (1)”.

Amendment of regulation 23

11.  In regulation 23 (bus lanes), in paragraph (2)—

(a)after sub-paragraph (b), omit “and”;

(b)in sub-paragraph (c), for “diagram 958 or 959” substitute “diagram 958, 958A, 959 or 959A”; and

(c)after sub-paragraph (c), insert—

and

(d)solo motor cycles where indicated on the sign shown in diagram 958A or 959A..

Amendment of regulation 24

12.  In regulation 24 (bus symbols), in paragraph (2), for “diagrams 958 and 959” substitute “diagrams 958, 958A, 959 and 959A”.

Amendment of regulation 26

13.—(1) Regulation 26 (road markings shown in diagrams 1013.1, 1013.3 and 1013.4: double white lines) is amended as follows.

(2) In paragraph (5)—

(a)in sub-paragraph (b), for the words beginning with “or, in England” and ending with “purposes”, substitute “or, in England and Wales, fire and rescue authority, ambulance, special forces, police or traffic officer purposes”; and

(b)in sub-paragraph (e), after “a constable in uniform or” insert “traffic officer in uniform or”.

(3) In paragraph (6)(h), after “a constable in uniform” insert “, a traffic officer in uniform”.

Amendment of regulation 27

14.  In regulation 27 (road marking shown in diagram 1001.3: zig-zag lines—no stopping), in paragraph (3)—

(a)in sub-paragraph (a), after “a constable in uniform” insert “, a traffic officer in uniform”;

(b)after sub-paragraph (b), omit “or”;

(c)in sub-paragraph (c), for the words beginning with “or, in England” and ending with “purposes”, substitute “or, in England and Wales, fire and rescue authority, ambulance, special forces or traffic officer purposes”; and

Amendment of regulation 29

15.  In regulation 29 (the heading to which becomes “Road markings shown in diagrams 1025.1, 1025.3, 1025.4, 1043, 1044, 1044.1 and 1044.2: bus stop and bus stand clearways and box junctions”), in paragraph (2), for “diagrams 1043 and 1044” substitute “diagrams 1043, 1044, 1044.1 and 1044.2”.

Amendment of regulation 31

16.  In regulation 31 (illumination of road markings), in paragraph (1), after “1001.2,” insert “1001.2A,”.

Amendment of regulation 36

17.  In regulation 36 (significance of light signals prescribed by regulations 33 to 35), in paragraph (2), after “a constable in uniform” insert “, a traffic officer in uniform”.

Substitution of regulation 38

18.  For regulation 38 (significance of light signals prescribed by regulation 37(1)), substitute—

38.(1) The significance of the light signals prescribed by regulation 37(1) shall be as follows.

(2) Subject to paragraph (5), the signals shown in diagram 6032.1 shall convey the prohibition that vehicular traffic on the carriageway beside which the signals are mounted shall not proceed beyond the signals.

(3) Subject to paragraph (5), when displayed over the carriageway of a road, the signals shown in diagram 6031.1 shall convey the prohibition that vehicular traffic proceeding in the traffic lane immediately below the signals shall not proceed beyond them in that lane.

(4) Subject to paragraph (5), when displayed over an actively managed hard shoulder, the signals shown in diagram 6031.1 shall convey the prohibition that vehicular traffic shall not enter the hard shoulder beyond the signals for any purpose.

(5) The prohibition mentioned in paragraph (2), (3) or (4), as the case may be, shall not apply—

(a)to a vehicle being used—

(i)for any of the purposes mentioned in regulation 36(1)(b); or

(ii)for traffic officer purposes,

when the observance of that prohibition would be likely to hinder the use of that vehicle for the purpose for which it is being used; or

(b)to a vehicle being used for special forces purposes..

Amendment of regulation 43

19.—(1) Regulation 43 (meaning of stop line and references to light signals) is amended as follows.

(2) In paragraph (2)—

(a)after “Where the road marking shown in diagram 1001.2” insert “or 1001.2A”; and

(b)in sub-paragraphs (a) and (b), after “a pedal cycle proceeding in the cycle lane” in each place where it occurs, insert “or through the cycle entry”.

(3) In paragraph (5)(c)—

(a)in sub-paragraph (i), after “the road markings shown in” insert “diagram 1001.2A or in”;

(b)in sub-paragraph (ii), for “in either version of that diagram” substitute “in diagram 1001.2A or in either version of diagram 1001.2”;

(c)after sub-paragraph (ii), omit “and”; and

(d)after sub-paragraph (iii), insert—

and

(iv)“the cycle entry” means the diagonal broken line shown in diagram 1001.2A. .

Amendment of regulation 46

20.  In regulation 46 (matrix signs for motorways and all-purpose dual carriageway roads), in paragraphs (1), (3) and (5), for “speed limit” in each place where it occurs, substitute “advised maximum speed”.

Amendment of regulation 47

21.—(1) Regulation 47 (light signals at signal-controlled pedestrian facilities) is amended as follows.

(2) After paragraph (2), insert—

(2A) Where a sign consisting of either a single unit of the size, colour and type shown in diagram 4003.1 or of two units, one comprising the upper and the other the lower part of that unit placed close together, is placed in relation to a crossing—

(a)any additional device for causing the green signal in that sign to become illuminated shall—

(i)be of the size, colour and type of only the part of that sign which includes the push button and the legend above it; and

(ii)comply with the requirements of paragraph (3)(e) so far as relevant to it; and

(b)any additional sign for conveying to pedestrian traffic the warning and information specified in paragraph (4) shall—

(i)be of the size, colour and type shown in diagram 4003.1A; and

(ii)comply with the requirements of paragraph (3)..

(3) Omit paragraph (5).

Amendment of regulation 48

22.—(1) Regulation 48 (light signals at equestrian crossings) is amended as follows.

(2) After paragraph (2), insert—

(2A) Where a sign consisting of either a single unit of the size, colour and type shown in diagram 4003.4 or of two units, one comprising the upper and the other the lower part of that unit placed close together, is placed in relation to a crossing—

(a)any additional device for causing the green signal in that sign to become illuminated shall—

(i)be of the size, colour and type of only the part of that sign which includes the push button and the legend above it; and

(ii)comply with the requirements of paragraph (3)(e) so far as relevant to it; and

(b)any additional sign for conveying to equestrian traffic the warning and information specified in paragraph (4) shall—

(i)be of the size, colour and type shown in diagram 4003.4A; and

(ii)comply with the requirements of paragraph (3)..

(3) Omit paragraph (5).

Amendment of regulation 49

23.—(1) Regulation 49 (light signals at Toucan crossings) is amended as follows.

(2) After paragraph (2), insert—

(2A) Where a sign consisting of either a single unit of the size, colour and type shown in diagram 4003.7 or of two units, one comprising the upper and the other the lower part of that unit placed close together, is placed in relation to a crossing—

(a)any additional device for causing the green signal in that sign to become illuminated shall—

(i)be of the size, colour and type of only the part of that sign which includes the push button and the legend above it; and

(ii)comply with the requirements of paragraph (3)(e) so far as relevant to it; and

(b)any additional sign for conveying to pedestrians and pedal cyclists the warning and information specified in paragraph (4) shall—

(i)be of the size, colour and type shown in diagram 4003.7A; and

(ii)comply with the requirements of paragraph (3)..

(3) For paragraph (3)(a), substitute—

(a)the—

(i)red figures (“the red signal”) in the signs shown in diagrams 4003.5, 4003.7 and 4003.7A; and

(ii)red cycle symbol (“the red signal”) in diagrams 4003.7 and 4003.7A,

can be internally illuminated by a steady light;.

(4) Omit paragraph (5).

Amendment of regulation 51

24.  In regulation 51 (cattle crossing signs and warning lights), in paragraph (1), after “A sign of the size, colour and type shown in diagram 4005” insert “, and which has ES compliant signal heads,”.

Amendment of regulation 53

25.—(1) Regulation 53 (temporary signs) is amended as follows.

(2) In paragraph (1)—

(a)after sub-paragraph (e)(iv), omit “or”; and

(b)after sub-paragraph (f), insert—

or

(g)warnings, or information, about—

(i)a civil emergency; or

(ii)the prospect of a civil emergency..

(3) After paragraph (6), insert—

(7) In this regulation, “a civil emergency” means—

(a)an emergency within the meaning of section 1 of the Civil Contingencies Act 2004(5); or

(b)terrorism within the meaning of section 1 of the Terrorism Act 2000(6)..

Amendment of regulation 54

26.  In regulation 54 (flashing beacons), in paragraph (2)(c), for “450” substitute “150”.

Substitution of regulation 55

27.  For regulation 55 (road danger lamps) and the heading to it, substitute—

Warning lights

55.(1) A lamp for indicating to traffic the limits of a temporary obstruction of the road (a “warning light”) shall comply with the requirements in paragraphs (2), (3), (4), (5) and (6).

(2) The height of the centre of each lens of the warning light from the surface of the road in the immediate vicinity of the lamp shall not exceed 1500 millimetres where the speed limit on the road is 40 mph or less, or 1200 millimetres where the speed limit on the road is more than 40 mph.

(3) The warning light—

(a)shall be powered separately from any other object or device; and

(b)shall show a steady or intermittent amber light.

(4) Subject to paragraphs (5) and (6), the whole of the warning light shall conform—

(a)to British Standard BS EN 12352:2006 incorporating corrigenda July 2008 and July 2009; or

(b)to a corresponding EEA Standard.

(5) In relation to each aspect of performance specified in column (2) of an item in the Table, the warning light shall comply with—

(a)the requirement or test specification of British Standard BS EN 12352:2006 incorporating corrigenda July 2008 and July 2009 specified in column (3) of the item; or

(b)an equivalent requirement or test specification specified in a corresponding EEA Standard.

(6) The external surface of the parts of the warning light which are not the lenses and are visible to road users shall be of a colour having the colorimetric values—

(a)of reference 355 Lemon, or reference 356 Golden yellow, in Table 1 (standard colours) of British Standard BS 381C : 1996; or

(b)of an equivalent reference specified in a corresponding EEA Standard..

Amendment of regulation 56

28.—(1) Regulation 56 (cones, delineators and cylinders) is amended as follows.

(2) For paragraph (2), substitute—

(2) A cone shall consist of a conically shaped device—

(a)the base of which—

(i)is of any single colour; and

(ii)is a polygon, having not more than eight sides, which would be contained wholly within a circle with a diameter of three quarters of the height of the cone; and

(b)which, subject to paragraph (15), conforms to British Standard BS EN 13422:2004+A1:2009 or to a corresponding EEA Standard..

(3) In paragraph (5), for “British Standard Specification BS873: Part 8: 1985” substitute “British Standard BS EN 13422:2004+A1:2009”.

(4) In paragraph (7), for sub-paragraph (b), substitute—

(b)which conforms to British Standard BS 8442:2006 or to a corresponding EEA Standard;.

(5) In paragraph (10), for “British Standard Specification BS 873: Part 8: 1985” substitute “British Standard BS EN 13422:2004+A1:2009”.

Amendment of regulation 58

29.—(1) Regulation 58 (variable message signs) is amended as follows.

(2) After paragraph (2), insert—

(2A) When a variable message sign displays—

(a)a sign shown in a diagram in Schedule 11 (except diagram 6031.1); or

(b)a legend of the type shown in Schedule 15,

any symbol or legend may be displayed in white, off-white or yellow on a dark   background..

(3) After paragraph (9) insert—

(10) When a variable message sign displays any of the following messages—

(a)a sign referred to in paragraph (1)(a) or (c);

(b)a legend referred to in paragraph (1)(b); or

(c)a sign referred to in sub-paragraph (a) or (b) of paragraph (7) accompanied, in accordance with that paragraph, by the legend “SLOW DOWN”,

the variable message sign shall display the whole of that message at the same time..

Amendment of Schedule 16

30.—(1) Schedule 16 (permitted variants) is amended as follows.

(1) Where the sign is placed pursuant to direction 37 in connection with works involving a temporary reduction in height, it—

(a)shall be reflectorised in accordance with regulation 19(3) and (4); and

(b)may also be illuminated by a means of internal or external lighting.

(a)is placed pursuant to direction 37 in connection with works involving a permanent reduction in height; and

(b)is erected on a road within 50 metres of any lamp lit by electricity which forms part of a system of street-lighting for that road furnished by means of at least three such lamps placed not more than 183 metres (in Scotland 185 metres) apart,

it shall be illuminated by a means of internal or external lighting either for so long as that system is illuminated, or throughout the hours of darkness, and may also be reflectorised.

Amendment of Part I of Schedule 19

32.—(1) Part I of Schedule 19 (significance of bus stop and bus stand clearway markings) is amended as follows.

(2) For paragraph 3, substitute—

3.(1) Where the sign shown in diagram 974 or 975 is placed and is not varied to “except local buses”, nothing in paragraph 2 applies to the driver of a bus who causes the bus to stop within the clearway for so long as may be necessary—

(a)to maintain a published timetable for the service (provided, in the case of a bus stop clearway, that the bus is not stopped within the clearway for a period exceeding two minutes);

(b)to enable passengers to board or alight from the bus; or

(c)to enable the crew of the bus to be changed.

(2) Where the sign shown in diagram 974 or 975 is placed and is varied to “except local buses”, nothing in paragraph 2 applies to the driver of a bus being used in the provision of a local service who causes the bus to stop within the clearway for so long as may be necessary—

(a)to maintain a published timetable for the service (provided, in the case of a bus stop clearway, that the bus is not stopped within the clearway for a period exceeding two minutes);

(b)to enable passengers to board or alight from the bus; or

(c)to enable the crew of the bus to be changed..

(3) In paragraph 4(1) (other exceptions)—

(a)in sub-paragraph (a), for “or police purposes” substitute “, police or traffic officer purposes”; and

(b)in sub-paragraph (b)—

(i)after sub-paragraph (ii), omit “or”; and

(ii)after sub-paragraph (iii), insert—

Amendment of Part II of Schedule 19

33.—(1) Part II of Schedule 19 (significance of box junction markings) is amended as follows.

(2) In paragraph 6, for—

(a)“box junction” means the area of carriageway marked with yellow cross-hatching at a junction between two or more roads on which there has been placed the road marking shown in diagram 1043 or 1044; and

substitute—

(a)“box junction” means the area of carriageway marked with yellow cross-hatching—

(i)at a junction between two or more roads;

(ii)at a gyratory system or roundabout;

(iii)where that area of carriageway is not greater than 4.5 metres wide at its narrowest point; or

(iv)on the length of road adjacent to the vehicular entrance to the premises of a fire, police or ambulance station,

on which there has been placed the road marking shown in diagram 1043, 1044, 1044.1 or 1044.2; and.

(3) In paragraph 7—

(a)in sub-paragraph (1), for—

Except when placed in the circumstances described in paragraph 8, the road markings shown in diagrams 1043 and 1044

substitute—

Subject to paragraph 9, the road markings shown in diagrams 1043, 1044 and 1044.1; and

(b)for sub-paragraph (2), substitute—

(2) The prohibition in sub-paragraph (1) does not apply to any person where the box junction is at a junction between two or more roads (but not at a gyratory system or roundabout) and the person—

(a)causes a vehicle to enter the box junction for the purpose of turning right; and

(b)stops the vehicle within the box junction for so long as the vehicle is prevented from completing the right turn—

(i)by oncoming vehicles; or

(ii)by vehicles which are stationary whilst waiting to complete a right turn..

(4) In paragraph 8, for—

When the road marking shown in diagram 1043 or 1044 is placed in conjunction with the signs shown in diagrams 615 and 811 on an area of carriageway which is less than 4.5 metres wide at its narrowest point, the road marking

(5) After paragraph 8, insert—

9.  When a vehicle is being used for relevant authority (as defined in section 6 of the Fire (Scotland) Act 2005 (asp 5)) or, in England and Wales, fire and rescue authority, ambulance, bomb or explosive disposal, national blood service or police purposes and the observance of the prohibition in paragraph 7(1) or 8 would be likely to hinder the use of that vehicle for the purpose for which it is being used, then that prohibition shall not apply to the driver of the vehicle..

Savings

35.—(1) Subject to paragraph (2), any traffic sign—

(a)which, immediately before the coming into force of these regulations, was—

(i)prescribed by the 2002 regulations; and

(ii)placed in compliance with the Traffic Signs General Directions 2002(7); and

(b)which ceases to be so prescribed on the coming into force of these regulations,

is to be treated as prescribed by the 2002 regulations for so long as it continues to comply with those regulations as in force immediately before the coming into force of these regulations.

(2) Paragraph (1) ceases to have effect—

(a)in relation to the signs shown in diagrams 832.1A, 832.2A, 2310.1, 2511 and 2512, on the expiry of the period of two years beginning with the date on which these regulations come into force; and

(b)in relation to the sign shown in diagram 2919.1, on the expiry of the period of ten years beginning with the date on which these regulations come into force.

36.—(1) For the purposes of regulation 35, a sign mentioned in paragraph (2) of this regulation that does not otherwise satisfy the requirement set out in regulation 35(1)(a)(ii) because it had not been placed on or near a road before the coming into force of these regulations is to be deemed to satisfy that requirement if—

(a)it is so placed within the 12 weeks beginning with the day these regulations come into force; and

(b)its placing complies with the Traffic Signs General Directions 2002.

(2) Those signs are—

(a)the signs shown in diagrams 622.1A, 626.2A, 640.2A, 665, 666, 818.4, 2108 and 7282 in the 2002 regulations as in force immediately before the coming into force of these regulations;

(b)the sign shown in diagram 818.3 in the 2002 regulations as in force immediately before the coming into force of these regulations to the extent that the diagram 629.2A symbol in it may be varied to—

(i)diagram 622.1A (with the symbol reversed as appropriate) in the 2002 regulations as in force immediately before the coming into force of these regulations; or

(ii)diagram 626.2A (prohibitory roundel only) in the 2002 regulations as in force immediately before the coming into force of these regulations; and

(c)the signs shown in the diagrams listed in item 31 of Schedule 16 to the 2002 regulations as in force immediately before the coming into force of these regulations, to the extent that they may be varied to display—

(i)the symbol in diagram 622.1A (with the symbol reversed as appropriate) in the 2002 regulations as in force immediately before the coming into force of these regulations; or

(ii)the symbol in diagram 626.2A (prohibitory roundel only) in the 2002 regulations as in force immediately before the coming into force of these regulations.

(3) The reference in paragraph (1) to the Traffic Signs General Directions 2002 is to those directions as in force immediately before the coming into force of Part 2 of this instrument.

PART 2The Traffic Signs (Amendment) (No. 2) General Directions 2011

Citation, commencement and interpretation

1.—(1) These general directions—

(a)may be cited as the Traffic Signs (Amendment) (No. 2) General Directions 2011;

(b)together with the regulations contained in Part 1 of this instrument, may be cited as the Traffic Signs (Amendment) (No. 2) Regulations and General Directions 2011; and

(c)come into force on 30th January 2012.

(2) In these general directions—

(a)“the 1984 Act” means the Road Traffic Regulation Act 1984(8); and

(b)“the 2002 general directions” means the Traffic Signs General Directions 2002(9).

Preliminary

2.  The 2002 general directions are amended as follows.

Amendment of direction 3

3.  In direction 3 (interpretation—general), for paragraph (1), substitute—

(1) In these Directions—

(a)“one-way road” means a road on which the driving of vehicles otherwise than in one particular direction is prohibited;

(b)“permit parking area” means an area into which each entrance for vehicular traffic has been indicated by the sign shown in diagram 663.3;

(c)“restricted parking zone” means an area—

(i)into which each entrance for vehicular traffic has been indicated by the sign shown in diagram 663.2; and

(ii)in which none of the road markings shown in diagrams 1017, 1018.1, 1019 and 1020.1 has been placed;

(d)“two-way street” means a road which is not a one-way road;

(e)the Regulations” means the Traffic Signs Regulations 2002; and

(f)the expressions listed in paragraph (2) have the same meaning as in the Regulations..

4.  In direction 7 (signs to be placed only to indicate the effect of a statutory prohibition), in paragraph (2)(a)—

(a)after “637.2,” insert “637.2A,”;

(b)after “660.7,” insert “660.8, 660.9,”;

(c)after “663.1,” insert “663.2, 663.3,”;

(d)after “664,” insert “664.1,”;

(e)for “958.1, 959, 959.1,” substitute “958A, 958.1, 959, 959A, 959.1,”; and

5.  In direction 8 (the placing of certain signs to indicate the beginning of a restriction, requirement, prohibition or speed limit)—

Amendment of direction 9

6.—(1) Direction 9 (beginning of a speed limit—further provisions) is amended as follows.

(2) In paragraph (4), for—

be placed not further than 20 metres from the junction and so as to be visible to such traffic, on each side of the carriageway by which traffic may pass from the relevant road into the other road.

substitute—

be placed—

(a)so as to be visible to such traffic; and

(b)not further than 20 metres from the junction—

(i)if the relevant road has only one carriageway, on each side of that carriageway; or

(ii)if the relevant road is a dual carriageway road, on each side of the carriageway by which traffic may pass from the relevant road into the other road..

(3) For paragraph (5)(b), substitute—

(b)signs indicating the maximum speed limit have been placed on the other road in accordance with direction 11 not more than 100 metres from the junction and—

(i)on each side of the junction; or

(ii)where traffic is permitted to enter the other road from the relevant road by proceeding onto the carriageway on only one side of the junction, on that side of the junction..

Amendment of direction 10

7.  In direction 10 (the placing of certain signs to indicate the end of a restriction, requirement, prohibition or speed limit)—

(a)in paragraph (1), after “664,” insert “664.1,”; and

(b)in paragraph (8), after “If the relevant road has” insert “only”.

Amendment of direction 11

8.—(1) Direction 11 (repeater signs) is amended as follows.

(2) In paragraph (1)—

(a)after “637.2,” insert “637.2A,”;

(b)after “660.6,” insert “660.7, 660.8, 660.9,”;

(c)after “661.1,” insert “661.2A,”;

(d)after “959,” insert “959A,”; and

(e)after “960.1” insert “, 960.2”.

(3) For paragraph (2), substitute—

(2) Subject to paragraphs (2A), (2B), (2C), (2D), (2E), (2F), (2G), (3) and (4), at least one of each of the signs to which this paragraph applies shall be placed—

(a)along a road which is subject to a restriction, requirement, prohibition or speed limit which can be indicated by the sign; and

(b)in the case of the signs shown in diagrams 614, 632, 642, 670 (except as mentioned in paragraph (1)), 672, 956, 957, 959, 959A, 959.1, 960, 960.1, 960.2 and 961, to face each stream of traffic to which the sign is intended to convey that restriction, requirement, prohibition or speed limit..

(4) After paragraph (2), insert—

(2A) The sign shown in diagram 614 need not be placed in accordance with paragraph (2)—

(a)where the prohibition indicated by that sign applies only at a point on a road and not along a length of road; or

(b)along a length of road which is subject to the prohibition indicated by that sign if that length of road—

(i)has only one carriageway; and

(ii)is shorter than 100 metres.

(2B) The sign shown in diagram 632 need not be placed in accordance with paragraph (2) along a length of road which is subject to the prohibition indicated by that sign if that length of road—

(a)has no junction with another road; and

(b)is shorter than 400 metres.

(2C) The sign shown in diagram 642 need not be placed in accordance with paragraph (2) along a length of road which is subject to the prohibition indicated by that sign if that length of road—

(a)is subject to a speed limit of 30 mph and is shorter than 800 metres;

(b)is subject to a speed limit of 40 mph and is shorter than 1100 metres;

(c)is subject to a speed limit of 50 mph and is shorter than 1350 metres; or

(d)is subject to a speed limit of 60 mph or to a national speed limit and is shorter than 1600 metres.

(2D) The signs shown in diagrams 660 and 660.3 need not be placed in accordance with paragraph (2) on a road within a permit parking area.

(2E) The sign shown in diagram 670 need not be placed in accordance with paragraph (2) along a length of road which is subject to the speed limit indicated by that sign if that length of road—

(a)is subject to a speed limit of 20 mph and is shorter than 200 metres;

(b)is subject to a speed limit of 30 mph, is shorter than 200 metres and does not have a system of carriageway lighting furnished by lamps lit by electricity;

(c)is subject to a speed limit of 40 mph and is shorter than 250 metres;

(d)is subject to a speed limit of 50 mph and is shorter than 350 metres; or

(e)is subject to a speed limit of 60 mph, is shorter than 400 metres and is a dual carriageway road or a motorway.

(2F) The sign shown in diagram 672 need not be placed in accordance with paragraph (2) along a length of road which is subject to the speed limit indicated by that sign if that length of road is shorter than 250 metres.

(2G) The signs shown in diagrams 959 and 959A need not be placed in accordance with paragraph (2) along a length of road along which, or along part of which, there is a bus lane if that length of road—

(a)has no junction with another road; and

(b)is shorter than 300 metres..

(5) For paragraph (3), substitute—

(3) The sign shown in diagram 670—

(a)when varied to “20”, need not be placed in accordance with paragraph (2) on a road within an area into which each entrance for vehicular traffic has been indicated by the sign shown in diagram 674; and

(b)when displayed on a variable message sign, need not be placed in accordance with paragraph (2) when the variable message sign is mounted on a gantry or other structure and is so placed that a traffic lane of the carriageway or an actively managed hard shoulder passes directly beneath it..

(6) In paragraph (4)(b), for “motorway” substitute “road”.

(7) For paragraph (5), substitute—

(5) Subject to paragraph (5A), at least one sign shown in diagram 671 shall be placed—

(a)along a length of road (other than a motorway) on which—

(i)there is a system of street or carriageway lighting furnished by lamps lit by electricity placed not more than 183 metres apart in England and Wales or not more than 185 metres apart in Scotland; and

(ii)a national speed limit is in force; and

(b)to face each stream of traffic to which the sign is intended to convey that speed limit..

(8) After paragraph (5), insert—

(5A) The sign shown in diagram 671 need not be placed in accordance with paragraph (5) along a length of road which is subject to the speed limit indicated by that sign if that length of road—

(a)has only one carriageway and is shorter than 400 metres; or

(b)is a dual carriageway road and is shorter than 450 metres.

(5B) In this direction, “bus lane” has the meaning given in regulation 23..

(9) Omit paragraphs (6) and (7).

Amendment of direction 13

9.  In direction 13 (signs to be placed only on specified types of road), in paragraph (3)—

(a)for “2310.1” substitute “2310.2”;

10.  After direction 13, insert—

13A.(1) The signs shown in diagrams 2703, 2704, 2705, 2706 and 2707 may not be placed on the main carriageways of a motorway.

(2) In this direction, “main carriageways of a motorway” means all those parts of a motorway—

(a)onto which vehicular traffic may pass from a motorway entrance slip road; and

(b)from which vehicular traffic may pass onto a motorway exit slip road, and

includes the carriageways, the central reservation, the hard shoulders and the verges.

(3) For the purposes of paragraph (2), “carriageway” and “verge” each has—

(a)in relation to a motorway in England or Wales, the same meaning as in the Motorways Traffic (England and Wales) Regulations 1982(10); and

(b)in relation to a motorway in Scotland, the same meaning as in the Motorways Traffic (Scotland) Regulations 1995(11)..

22.  In direction 37 (restrictions on the placing of temporary signs), after paragraph (1), insert—

(1A) The sign shown in diagram 7014.1 may, in relation to a bridge under which a road passes, be placed only in connection with works involving a temporary or permanent reduction in the maximum height of vehicle able to pass, on the road, under the bridge (in this direction, “temporary reduction” and “permanent reduction” respectively).

(1B) Where the sign shown in diagram 7014.1 is placed in connection with works involving a temporary reduction, it may be retained only until completion of those works.

New direction 38A

23.  After direction 38 (restrictions on the placing of temporary signs), insert—

38A.(1) A warning light which shows an intermittent light may not be placed—

(a)more than 50 metres from a street lamp lit by electricity; or

(b)on a road subject to a speed limit of more than 40 mph.

(2) In this direction, “warning light” has the same meaning as in regulation 55..

24.  Direction 40 is revoked.

Amendment of direction 41

25.—(1) Direction 41 (mounting and backing of signs) is amended as follows.

(2) In paragraph (1), for “Subject to paragraphs (2) and (3)” substitute “Subject to paragraphs (2), (3) and (3A)”.

(3) After paragraph (3), insert—

(3A) The signs shown in diagrams 606, 610, 611, 616, 951, 955, 956 and 957 may be mounted on—

(a)a bollard which—

(i)is illuminated by means of internal lighting; and

(ii)conforms to British Standard BS EN 12899-2:2007 or to a corresponding EEA Standard; or

(b)a self-righting bollard which—

(i)is illuminated by the use of retroreflecting material; and

(ii)conforms to British Standard BS 8442:2006 or to a corresponding EEA Standard..

Amendment of direction 42

26.—(1) Direction 42 (mounting and backing of signs) is amended as follows.

(2) In paragraphs (1)(b)(ii) and (3)(b), for “BS 873” substitute “BS EN 12899-1:2007 Incorporating corrigenda May 2008 and June 2009”.

New direction 44A

27.  After direction 44 (mounting of the signs shown in diagrams 560 and 561), insert—

Mounting of signs with light signals

44A.(1) Subject to paragraphs (2), (3), (4), (5) and (6), where the light signals prescribed by regulation 33 (whether or not varied in accordance with regulation 34) (“the regulation 33 signals”) or 47 are mounted on a post or other support specially provided for the purpose (“the post”), no other signs may be mounted on the post or affixed, whether directly or indirectly, to those light signals.

(2) One of each of the signs shown in diagrams 606, 612, 613, 614, 616, 954.5, 954.6 and 954.7 may be affixed to the regulation 33 signals, but only if those signs are so placed that they face the stream of traffic to which they are intended to convey the warnings, information, requirements, restrictions or prohibitions prescribed by the Regulations.

(3) One of each of the signs shown in diagrams 606, 612, 613, 614 and 616 may, in addition to or instead of being affixed to the regulation 33 signals, be mounted on the post, but only if—

(a)those signs are, when mounted on the post, so placed that they face the stream of traffic to which they are intended to convey the warnings, information, requirements, restrictions or prohibitions prescribed by the Regulations; and

(b)where the sign shown in any particular one of those diagrams is, in addition to being mounted on the post, affixed to the light signals, the sign shown in that diagram does not, when mounted on the post, face the same stream of traffic as is faced by the sign which is shown in that diagram and affixed to the light signals.

(4) Where the regulation 33 signals are mounted on the post, additional regulation 33 signals may be mounted on the post.

(5) One of each of the signs shown in diagrams 543.1, 954, 954.2, 954.3, 954.4, 7016 and 7019 may be mounted on the post, but only if those signs are so placed that they face the stream of traffic to which they are intended to convey the information prescribed by the Regulations.

(6) Paragraph (1) does not prohibit the mounting, on the post, of the signs shown in diagrams 4002.1, 4003, 4003.1, 4003.1A (when placed with the sign shown in diagram 4003.1), 4003.2, 4003.3, 4003.4, 4003.4A (when placed with the sign shown in diagram 4003.4), 4003.5, 4003.6, 4003.7 and 4003.7A (when placed with the sign shown in diagram 4003.7)..

Amendment of direction 46

28.—(1) Direction 46 (mounting and backing of light signals, matrix signs and warning lights) is amended as follows.

(2) In paragraph (2)(b)—

Substitution of direction 47

29.  For direction 47 (placing of road marking shown in diagram 1001 or 1001.2 in conjunction with light signals), and the heading to it, substitute—

47.(1) The light signals prescribed by regulation 33(1) may be placed only in conjunction with—

(a)the road marking shown in diagram 1001; or

(b)subject to direction 18(2), the road marking shown in diagram 1001.2 or 1001.2A.

(2) The light signals prescribed by regulation 33(2) or 39(1) may be placed only in conjunction with the road marking shown in diagram 1001.

(3) Paragraphs (1) and (2) shall not apply to light signals while works which necessitate the temporary removal of a road marking are being executed on a road near the light signals..

Amendment of direction 49

30.  In direction 49 (placing of road marking shown in diagram 1001.3—zig-zag lines), in paragraph (1)(a)—

(a)after “4003.4” insert “(whether or not placed with the signal shown in diagram 4003.4A)”; and

(b)after “4003.7” insert “(whether or not placed with the signal shown in diagram 4003.7A)”.

Amendment of direction 54

31.  In direction 54 (placing of signals and other signs at crossings), for the words “at signal-controlled crossing facilities” to the end, substitute—

at signal-controlled crossing facilities where all streams of vehicular traffic are stopped only for the purpose of enabling pedestrians, cyclists or equestrians to cross the carriageway..

Amendment of direction 55

32.—(1) Direction 55 (placing of various light signals) is amended as follows.

(2) In paragraph (6), after “the light signals shown in diagram” insert “3000.2 or”.

(3) After paragraph (7), insert—

(7A) The light signals shown in diagram 4003.1 may be placed only in conjunction with—

(a)the light signals prescribed by regulation 33(1) or (2); or

(b)the light signals prescribed by regulation 33(1) or (2) and the light signals shown in diagram 4003.1A.

(7B) The light signals shown in diagram 4003.1A may be placed only in conjunction with the light signals shown in diagram 4003.1 and the light signals prescribed by regulation 33(1) or (2)..

(4) For paragraph (8), substitute—

Amendment of direction 56

33.  In direction 56 (approval of types of sign and signals by the Secretary of State), in paragraph (2)(f), for “2511, 2512” substitute “2511.1, 2512.1”.

Amendment of direction 57

34.—(1) Direction 57 (studs) is amended as follows.

(2) In paragraph (4), for ““the European Standards” means European Standards EN 1463—1: 1997 and 1463—2: 2000” substitute ““the British Standards” means British Standards BS EN 1463-1:1998 Incorporating Amendment No. 1 and BS EN 1463-2:2000”.

(3) For paragraph (5), substitute—

(5) A type of stud meets the requirements of this paragraph if and only if, being a type of stud which falls within a description specified in column (2) of an item in the table, it meets—

(a)the requirement or test specification, of the British Standards, specified in column (3) of the item, as that requirement or specification applies to studs within the class specified in that column; or

(b)a requirement or test specification, in a corresponding EEA Standard, equivalent to the requirement or test specification of those British Standards as that requirement or specification of the British Standards applies to studs within the class specified in that column..

(4) In the “NOTE” beneath the table, for “the European Standards” substitute “the British Standards”.

Amendment of Schedule 1 to the general directions

35.—(1) Schedule 1 to the 2002 general directions (placing of signals and other signs at signal-controlled crossing facilities) is amended as follows.

(2) In paragraph 1, after the definition of “near side signals” insert—

“supplementary near side signals” means a sign of the size, colour and type shown in diagram 4003.1A, 4003.4A and 4003.7A;.

(3) In paragraph 6(4) (near side signals at crossings)—

(a)in paragraph (a), for “regulation 49(5) or (8)” substitute “regulation 47(2A), 48(2A), 49(2A) or 49(8)”;

(b)after paragraph (a), omit “and”; and

(c)after paragraph (b), insert—

and

(c)one set of supplementary near side signals may be placed above each set of near side signals at the crossing..

Saving

36.—(1) Paragraph (2) applies to any sign which—

(a)is shown in diagram 832.1A, 832.2A, 2310.1, 2511, 2512 or 2919.1 in the Traffic Signs Regulations 2002(12) as in force immediately prior to the coming into force of the Traffic Signs (Amendment) (No. 2) Regulations 2011(13); and

(b)is, by regulation 35 of the Traffic Signs (Amendment) (No. 2) Regulations 2011, treated as prescribed by the 2002 regulations.

(2) Subject to paragraphs (3) and (4), in relation to a sign to which this paragraph applies, any provision of the 2002 general directions, as amended by these general directions, which would, but for the omission by these general directions of references to the diagram in which that sign is shown, refer to that diagram, is to be treated as referring to that diagram notwithstanding the omission, by these general directions, of the reference to that diagram in that provision.

(3) In relation to the signs shown in each of diagrams 832.1A, 832.2A, 2310.1, 2511 and 2512, paragraph (2) ceases to have effect on the expiry of the period of two years beginning with the date on which these general directions come into force.

(4) In relation to the sign shown in diagram 2919.1, paragraph (2) ceases to have effect on the expiry of the period of ten years beginning with the date on which these general directions come into force.

EXPLANATORY NOTE

(This note is not part of the instrument)

This instrument amends the Traffic Signs Regulations and General Directions 2002 (S.I. 2002/3113, “the TSRGD 2002”).

Bus lanes, clearways—Regulations 10, 11, 12, 15, 31(4)(a)(v) and 32(2), and directions 4(e), 8(2)(d), 12(a) and (b), 13(4)(b) and (c) and 14(d), amend in relation to bus lanes and to clearways.

Civil emergency signs—Regulation 25 amends to make provision about temporary signs for conveying traffic warnings or information about a civil emergency or the prospect of a civil emergency.

Corrections—Regulations 3(5), 4 and 20, and directions 5(b), 7(b) and 31, make corrections.

Designated lane—Regulation 3 inserts a definition of a “designated lane”. See, in relation to this, road marking 1049 as substituted by these amending regulations, and new sign 959A inserted by these amending regulations.

Illumination—Regulations 16 and 31 amend in relation to illumination of signs, including road markings.

Mounting and backing of signs—Directions 25, 26, 27 and 28 amend in relation to mounting and backing of signs.

Mutual recognition—Amendments by regulations 27 and 28, and by directions 25, 26(2) and 34, allow for mutual recognition of equipment meeting requirements in other European Union member states or in states which are contracting parties to the Agreement on the European Economic Area.

New signs and changes to signs—New diagrams for signs are prescribed, and amendments to prescribed signs (or to their meaning) are made, by regulations 21, 22, 23, 24, 26, 27, 28, 29, 33 and 34 and by the schedule to these amending regulations. Some diagrams are revoked. Consequential amendments are made by regulations 3(4), (6) and (7), 5, 7, 9, 12, 15, 16, 19(3)(a), 30 and 31, and by directions 4, 5(a), 7(a), 8(2), 9, 11, 12, 13, 14, 21, 22, 28, 29, 30, 32 and 33.

Offences—Regulation 5 amends the offences provisions in regulation 10 of the TSRGD 2002. The amendment means that section 36 of the Road Traffic Act 1988 applies to the new box junction markings shown in new diagrams 1044.1 and 1044.2. (Section 36 already applied to the existing box junction markings shown in diagrams 1043 and 1044.)

Parking—Amendments to provide for parking in relation to car clubs and to electric vehicles are made by regulations 30(9)(a), (20)(b) and (21)(a) and 31(7)(c), and by directions 4(b), 8(2)(b), 15 and 16. Amendments to provide for parking in relation to permit holders are made by regulations 30(20)(c) and (21)(b) and 31(4)(a)(ii), and by directions 3, 4(c) and (d), 5(a), 7(a), 8(4), 15(4), 16(4) and 18. Amendments to provide for a restricted parking zone are made by regulations 30(20)(a) and (c) and (21)(b) and 31(4)(a)(ii) and (7)(b), and by directions 3, 4(a) and (c), 5(a), 8(2)(a) and 18.

Permitted variants—Amendments to permitted variants for signs are made by regulations 8 and 30 (amends Schedule 16 to the TSRGD 2002) and in tables accompanying some diagrams.

Placing of signs—Directions 6, 8, 9, 10, 11, 12, 13, 14, 17, 19, 20, 21, 22, 23, 24, 29, 30, 31, 32 and 35 amend in relation to other placing of signs. These amendments include the revocation of the requirement for repeater signs to be placed at regular intervals (amendments to direction 11 of the TSRGD 2002 by direction 8 of this instrument).

Road markings—Regulations 6, 15, 16, 19 and 33, and directions 12, 13, 15, 16, 29 and 30, amend in relation to road markings. These include a new “cycle entry” marking (regulation 19 and new diagram 1001.2A). Also included are two new box junction markings.

Supplementary near side signals are provided for by amendments in regulations 3(4), (6) and (7), 21, 22 and 23 and in directions 32 and 35.

Traffic officers—Regulations 3(8), 13, 14, 17, 18 and 32(3) amend to make provision relating to traffic officers.

Updates—Regulations 27 and 28, and directions 19, 26(2) and 34(2), amend to update references.

Savings—Regulations 35 and 36 and direction 36 provide for savings so that certain signs that would otherwise not comply with the TSRGD 2002 as amended by this instrument can be used.

This instrument was notified in draft to the European Commission in accordance with directive 98/34/EC as amended by directive 98/48/EC. 1984 c.27. Powers conferred by section 64 on “the Ministers acting jointly” were, by S.I. 1999/3143, transferred to the Secretary of State (see primarily article 2(1)). Functions of a Minister of the Crown under the Road Traffic Regulation Act 1984 are (with exceptions), so far as exercisable in relation to Wales, transferred by S.I. 1999/672 to the National Assembly for Wales. The exceptions include the power in section 64 to prescribe a sign.
