The Road Vehicles (Powers to Stop) Regulations 2011

The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 19721 and section 95(1) of the Transport Act 19682.
The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to matters relating to the testing of the roadworthiness of motor vehicles and their trailers3; the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme4; the regulation and supervision of qualifications and working conditions of persons engaged in road transport5; and the carriage of passengers and goods by road6.
In accordance with section 101(6) of the Transport Act 1968 the Secretary of State has consulted with such representative organisations as he thinks fit.
A draft of this instrument has been laid before Parliament in accordance with paragraph 2(2) of Schedule 2 to the European Communities Act 1972 and section 101(3A) of the Transport Act 1968 and approved by a resolution of each House of Parliament.
