Exclusions: standard of proof10
Where it falls to—
a
the head teacher, in exercise of the power conferred by section 51A(1) of the Act;
b
the governing body, in exercise of their functions for the purposes of regulations 6 and 8; or
c
the review panel, in exercise of its functions for the purposes of regulation 7,
to establish any fact, any question as to whether that fact is established is to be decided on a balance of probabilities.
