Section 29 (commitment to prison) is amended as follows.

In subsection (1), in the provisions to be inserted into section 40 of the 1991 Act—

a

in subsection (2A), for “Commission” (in both places) substitute “Secretary of State” and for “it” (in both places) substitute “the Secretary of State”; and

b

in subsections (2B) and (2D)(a), for “Commission” substitute “Secretary of State”.

In subsection (3), in the provisions to be inserted into section 40A of the 1991 Act—

a

in subsection (A1), for “Commission” (in both places) substitute “Secretary of State” and for “it” (in both places) substitute “the Secretary of State”; and

b

in subsections (A2) and (A4)(a), for “Commission” substitute “Secretary of State”.
