The Cumbria (Electoral Changes) Order 2012

Made

Coming into force in accordance with article 2

Under section 58(4) of the Local Democracy, Economic Development and Construction Act 20091 (“the 2009 Act”) the Local Government Boundary Commission for England2 published a report dated July 2012 stating its recommendations for changes to the electoral arrangements for the county of Cumbria.

A draft of the instrument has been laid before Parliament and a period of forty days has expired and neither House has resolved that the instrument be not made.

The Local Government Boundary Commission for England has decided to give effect to the recommendations for electoral changes and in exercise of the powers conferred by section 59(1) of the 2009 Act makes the following Order:

Citation1

This Order may be cited as the Cumbria (Electoral Changes) Order 2012.

Commencement2

1

Articles 1 to 4 come into force—

a

for the purpose of proceedings preliminary or relating to the elections of councillors for county electoral divisions, on the day after that on which it is made;

b

for all other purposes, on the ordinary day of election of councillors in 2013.

Article 8 comes into force—

a

for the purpose of proceedings preliminary or relating to the elections of parish councillors, on 15th October 2013;

b

for all other purposes, on the ordinary day of election of councillors in 2014.

Articles 5 to7, 9 to 12 and 14 come into force—

a

for the purpose of proceedings preliminary or relating to the elections of parish councillors, on 15th October 2014;

b

for all other purposes, on the ordinary day of election of councillors in 2015.

Article 13 comes into force—

a

for the purposes of proceedings preliminary or relating to the elections of parish councillors, on 15th October 2015;

b

for all other purposes, on the ordinary day of election of councillors in 2016.

Interpretation3

In this Order—

  • “map” means the map marked “Map referred to in the Cumbria (Electoral Changes) Order 2012”, of which prints are available for inspection at the principal office of the Local Government Boundary Commission for England;

  • “ordinary day of election of councillors” has the meaning given by section 37 of the Representation of the People Act 19833.

Electoral divisions of the county of Cumbria and number of councillors4

The existing electoral divisions of the county of Cumbria are abolished.

The county is divided into eighty-four electoral divisions each bearing a name listed in the Schedule.

Each electoral division comprises the area designated on the map by reference to the name of the electoral division.

One councillor is to be elected for each electoral division.

Where a boundary is shown on the map as running along a road, railway line, footway, watercourse or similar geographical feature, it is to be treated as running along the centre line of the feature.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes changes to the electoral arrangements for the county of Cumbria following recommendations made by the Local Government Boundary Commission for England. The area of the county remains unchanged.

The electoral changes apply in respect of local government elections to be held on and after the ordinary day of election of councillors in 2013.

Article 4 abolishes the existing electoral divisions of the county and replaces them with 84 new ones. That article, the map and the Schedule also establish the names and areas of the new electoral divisions and the number of councillors for each electoral division.

Article 5 abolishes the existing wards of the parish of Cleator Moor and replaces them with 3 new ones. That article and the map also establish the names and areas of the new wards and the number of councillors for each ward.

Article 6 abolishes the existing wards of the parish of Cockermouth and replaces them with 5 new ones. That article and the map also establish the names and areas of the new wards and number of councillors for each ward.

Article 7 abolishes the existing wards of the parish of Egremont and replaces them with 4 new ones. That article and the map also establish the names and areas of the new wards and number of councillors for each ward.

Article 8 abolishes the existing wards for the parish of Kendal and replaces them with 16 new ones. That article and the map also establish the names and areas of the new wards and number of councillors for each ward.

Article 9 abolishes the existing wards for the parish of Maryport and replaces them with 7 new ones. That article and the map also establish the names and areas of the new wards and number of councillors for each ward.

Article 10 abolishes the existing wards for the parish of Millom and replaces them with 3 new ones. That article and the map also establish the names and areas of the new wards and number of councillors for each ward.

Article 11 establishes 4 wards for the parish of St Cuthbert Without. That article and the map also establish the names and areas of the new wards and the number of councillors for each ward.

Article 12 abolishes the existing wards for the parish of Stanwix Rural and replaces them with 5 new ones. That article and the map also establish the names and areas of the new wards and number of councillors for each ward.

Article 13 abolishes the existing wards for the parish of Wetheral and replaces them with 6 new ones. That article and the map and also establish the names and areas of the new wards and number of councillors for each ward.

Article 14 abolishes the existing wards for the parish of Workington and replaces them with 11 new ones. That article and the map and also establish the names and areas of the new wards and number of councillors for each ward.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
