The Secretary of State, in exercise of the powers conferred by paragraph 1 of Schedule 2 to the Police Act 1996(1), makes the following Regulations.

In accordance with the provisions of paragraph 6 of Schedule 2 to the Act the Secretary of State has consulted with the Association of Police Authorities, persons whom she considered to represent the interests of county and district councils in England and county and county borough councils in Wales, and such other persons as she thought fit.

Citation and commencement

1.  These Regulations may be cited as the Police Authority (Amendment) Regulations 2012 and shall come into force on 1st April 2012.

Amendment of the Police Authority Regulations 2008

2.—(1) The Police Authority Regulations 2008(2) are amended as follows.

(2) In regulation 19A (extension of existing terms pending abolition of police authorities), for “10th May” substitute (in both places) “22nd November”.

(3) In regulation 41 (requirement to advertise)—

(a)in paragraph (1), for the words after “they shall” substitute “advertise, in such manner as they think fit, the vacancy that exists or will exist amongst the members of the police authority”;

(b)omit paragraphs (2) and (3).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Police Authority Regulations 2008 (S.I. 2008/630 – “the 2008 Regulations”) in order further to extend the terms of office of independent members of police authorities, pending the abolition of those authorities by the Police Reform and Social Responsibility Act 2011. The 2008 Regulations were previously amended by the Police Authority (Amendment No. 3) Regulations 2010 (S.I. 2010/3030) so as to provide for any such term of office due to expire before 10th May 2012 to be extended until that date. These Regulations have the effect that a term of office due to expire before 22nd November 2012 is extended until that date.

These Regulations further amend the 2008 Regulations by replacing the requirement to publish notices in at least two newspapers conveying specified information about any vacancy among the independent members of a police authority with a requirement to advertise the vacancy in such manner as the authority’s selection panel thinks fit.

1996 c. 16. Schedule 2 was substituted by paragraph 2 of Schedule 2 to the Police and Justice Act 2006 (c. 48) and is prospectively repealed by paragraph 46 of Schedule 16 to the Police Reform and Social Responsibility Act 2011 (c. 13).

S.I. 2008/630. Regulation 19A was inserted by S.I. 2010/3030. Regulation 41 was amended by S.I. 2010/2826. There have been further amendments to the Regulations, but none is relevant.
