The Energy Act 2011 (Commencement No 2) Order 2013

The Secretary of State, in exercise of the power conferred by section 121(1) of the Energy Act 2011(1), makes the following Order.

Citation and interpretation

1.—(1) This Order may be cited as the Energy Act 2011 (Commencement No 2) Order 2013.

(2) In this Order, “the Act” means the Energy Act 2011.

Provisions which have been commenced for certain purposes and which come into force on 28th January 2013 for all remaining purposes

2.  The following provisions of Chapter 1 of Part 1 of the Act (green deal) come into force on 28th January 2013 for all purposes for which they are not already in force—

(a)sections 1 and 2 (green deal plans);

(b)sections 4, 5, 7 to 9 and 11(2) (green deal plan);

(c)sections 12, 13, 14(1) to (5) and 14(9) (disclosure of green deal plans etc);

(d)section 29 (early repayment of green deal finance).

Provisions coming into force on 28th January 2013

3.  The following provisions of Chapter 1 of Part 1 of the Act (green deal) come into force on 28th January 2013—

(a)sections 23 and 24 (gas and electricity codes);

(b)sections 25 to 28 (modifying consumer credit legislation).

EXPLANATORY NOTE

(This note is not part of the Order)

Article 2 of this Order brings into force for all remaining purposes certain provisions of Chapter 1 of Part 1 of the Energy Act 2011 (which relates to the green deal). These are sections 1, 2, 4, 5, 7 to 9 and 11 (which deal with green deal plans), sections 12, 13, 14(1) to (5) and 14(9) (which deal with disclosure of a green deal plan and related matters), and section 29 (which deals with early repayment of green deal finance). These provisions were brought into force for certain purposes by the Energy Act 2011 (Commencement No 1 and Saving) Order 2012 (S.I. 2012/873 (C.24)).

Article 3 of this Order brings into force sections 23 to 28 of the Act. Sections 23 and 24 make amendments to the gas code and the electricity code (which are contained in the Gas Act 1986 and the Electricity Act 1989 respectively). Sections 25 to 28 make amendments to certain provisions of the Consumer Credit Act 1974.
