TOWN AND COUNTRY PLANNING
Section 62A of the Town and Country Planning Act 1990 (“the 1990 Act”) provides that a local planning authority may be designated by the Secretary of State. Where an authority is designated a person applying for planning permission for major development may choose to submit their application to the Secretary of State for determination.

Certificates in relation to notice of applications10

Where a relevant application for planning permission is made, the applicant must certify, in a form published by the Secretary of State that the requirements of article 9 have been satisfied.
2
If an applicant has cause to rely on article 9(4), the certificate must state the relevant circumstances.
