5.—(1) Section 84 (matters which may be dealt with by prospectus rules)(1) is amended as follows.
(2) In subsection (1)—
(a)in paragraph (a) omit “(including a summary)”; and
(b)in paragraph (c) omit “(including a summary)”.
(3) After subsection (1) —
“(1A) In subsection (1) “prospectus” includes any part of a prospectus, and in particular includes a summary and a supplement.”
(4) For subsection (2)(i) substitute—
“(i)the exercise of entitlements under Article 4 of the prospectus regulation, or elections under Article 2(m)(ii) or (iii) of the prospectus regulation as applied for the purposes of this Part by section 102C.”.
(5) In subsection (4), for “directive” substitute “regulation”.
(6) Omit subsections (5) and (6).
Section 84 was substituted by S.I. 2005/1433 and subsections (1) and (2) subsequently amended by section 16 of the Financial Services Act 2012 c. 21.
