44.—(1) Section 89 is amended as follows.

(2) In subsection (1)—

(a)in the definition of “the applicable Community rules”M1, for the words from “means” to the end substitute “ has the meaning given by section 103(1) of the Transport Act 1968 ”;

(b)in the definition of “contracting third country”M2—

(i)omit “third”;

(ii)omit “other than a member State”;

(iii)omit paragraph (b) (and the “or” before it).
