PART 2Amendments to legislation applying in relation to England and Wales and Scotland

Amendment of the Income Support (General) Regulations 1987

2.—(1) The Income Support (General) Regulations 1987(1) are amended as follows.

(2) In regulation 2(1) (interpretation), after the definition of “adoption leave” insert—

adult disability payment” has the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022(2);.

(3) In regulation 4(2)(c)(v)(aa) (temporary absence from Great Britain)—

(a)for “or” after “armed forces independence payment” substitute “,”;

(b)after “personal independence payment” insert “or the enhanced rate of the daily living component of adult disability payment”.

(4) In paragraph 4(a) (persons caring for another person) of Schedule 1B (prescribed categories of person)—

(a)in sub-paragraph (i)—

(i)for “or” after “(see regulation 11(5) of those Regulations),” substitute “,”;

(da)a young person who is in receipt of adult disability payment or who would, but for regulation 28 (effect of admission to hospital on ongoing entitlement to Adult Disability Payment) of the Disability Assistance for Working Age People (Scotland) Regulations 2022, be so in receipt provided that the young person continues to be a member of the family; or;

(ii)in sub-paragraph (2), after “(d)” insert “, (da)”.

(7) In Schedule 3 (housing costs)—

(a)in paragraph 18(6)(b)(iii) (non-dependant deductions) omit “or” at the end; and

(b)after paragraph 18(6)(b)(iii) insert—

(iiia)the daily living component of adult disability payment; or;

(c)in paragraph 18(8)(a), for “or personal independence payment” substitute “, personal independence payment, adult disability payment”.

(8) In Schedule 9 (sums to be disregarded in the calculation of income other than earnings)—

(a)in paragraph 6—

(i)after “disability living allowance” for “or” substitute “,”; and

(ii)after “personal independence payment” insert “or the mobility component of adult disability payment”;

(b)in paragraph 9—

(i)after “disability living allowance” for “or” substitute “,”; and

Amendment of the Social Security (Claims and Payments) Regulations 1987

3.—(1) The Social Security (Claims and Payments) Regulations 1987(3) are amended as follows.

(2) In regulation 6 (date of claim)—

(a)in paragraph (20)(a), after “appeal” insert “, determination of entitlement”;

(b)in paragraph (20)(c)(ii) at the end omit “or”;

(c)after paragraph (20)(c)(ii) insert—

(iii)regulation 17 (effect of admission to a care home on ongoing entitlement to care component) of the Disability Assistance for Children and Young People (Scotland) Regulations 2021(4) because the claimant is resident in a care home, or

(iv)regulation 27 (effect of admission to a care home on ongoing entitlement to daily living component), or as the case may be, regulation 28 (effect of admission to hospital on ongoing entitlement to Adult Disability Payment) of the Disability Assistance for Working Age People (Scotland) Regulations 2022 because the claimant is, respectively, a resident of a care home or undergoing treatment in a hospital;

(i)adult disability payment within the meaning of regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022; and

(ii)child disability payment within the meaning of regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021..

Amendment of the Social Security (Disability Living Allowance) Regulations 1991

4.—(1) The Social Security (Disability Living Allowance) Regulations 1991(6) are amended as follows.

(2) In regulation 1(2) (citation, commencement and interpretation), in the relevant place insert—

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

(3) In regulation 6(1) (qualifying period for care component after an interval)—

(a)after “entitled to the care component” insert “of disability living allowance, or the care component of child disability payment”;

(b)after “entitlement to the care component” insert “of disability living allowance, or the care component of child disability payment”.

(4) In regulation 11 (qualifying period for mobility component after an interval)—

Amendment of the Jobseeker’s Allowance Regulations 1996

5.—(1) The Jobseeker’s Allowance Regulations 1996(7) are amended as follows.

(2) In regulation 1(3) (citation, commencement, interpretation and application), after the definition of “adoption leave” insert—

adult disability payment” has the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022;.

(3) In regulation 51(3)(c) (remunerative work)—

(a)in paragraph (i)—

(i)after “DACYP Regulations,” omit “or”;

(ii)after “enhanced rate” insert “, or the daily living component of adult disability payment at the standard or enhanced rate”;

Amendment of the Social Security and Child Support (Decisions and Appeals) Regulations 1999

6.—(1) The Social Security and Child Support (Decisions and Appeals) Regulations 1999(8) are amended as follows.

(2) In regulation 1(3) (citation, commencement, application and interpretation)—

(a)omit the definition of “child disability payment”;

(b)after the definition of “relevant credit” insert—

Scottish disability benefit” means, as the context requires, either of the following benefits—

(a)

adult disability payment within the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022; and

(b)

child disability payment within the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

(3) In regulation 3(7)(b) (revision of decisions), for each occurrence of “child disability payment” substitute “Scottish disability benefit”.

(4) In regulation 6(2)(e)(ii) (supersession of decisions), for each occurrence of “child disability payment” substitute “Scottish disability benefit”.

(5) In regulation 7(7)(a) (date from which a decision superseded under section 10 takes effect) for each occurrence of “child disability payment” substitute “Scottish disability benefit”.

Amendment of the Housing Benefit and Council Tax Benefit (Decisions and Appeals) Regulations 2001

7.—(1) The Housing Benefit and Council Tax Benefit (Decisions and Appeals) Regulations 2001(9) are amended as follows.

(2) In regulation 1(2) (citation, commencement and interpretation)—

(a)omit the definition of “child disability payment”;

(b)after the definition of “relevant decision” insert—

Scottish disability benefit” means, as the context requires, either of the following benefits—

(a)

adult disability payment within the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022; and

(b)

child disability payment within the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

(3) In regulation 4(7B)(b) (revision of decisions), for each occurrence of “child disability payment” substitute “Scottish disability benefit”.

(4) In regulation 7(2)(i)(ii) (decisions superseding earlier decisions), for each occurrence of “child disability payment” substitute “Scottish disability benefit”.

(5) In regulation 8(14) (date from which a decision superseding an earlier decision takes effect) for each occurrence of “child disability payment” substitute “Scottish disability benefit”.

Amendment of the State Pension Credit Regulations 2002

8.—(1) The State Pension Credit Regulations 2002(10) are amended as follows.

(2) In regulation 1(2) (citation, commencement and interpretation), after “adoption leave” insert—

adult disability payment” has the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022;.

(3) In Schedule 1—

9.—(1) The Housing Benefit Regulations 2006(11) are amended as follows.

adult disability payment” has the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022;;

Amendment of the Housing Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006

10.—(1) The Housing Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006(12) are amended as follows.

(2) In regulation 2(1) (interpretation)—

14.—(1) The Social Security (Personal Independence Payment) Regulations 2013(16) are amended as follows.

(2) In regulation 2 (interpretation)—

(a)in the appropriate places insert—

adult disability payment” has the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022;; and

child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;;

(b)in the definition of “prescribed date” replace “14 or 15” with “14, 15 or 15A”;

(3) In regulation 7(3) (scoring: further provision), in paragraphs (a)(i) and (b)(i), after “regulation 15” insert “or 15A”.

(4) In regulation 14 (the prescribed date) after “regulation 15” insert “or paragraph (2) or (3) of regulation 15A”.

(5) In regulation 15 (the prescribed date: claims for personal independence payment after an interval)—

(6) After regulation 15 insert—

The prescribed date: claims for personal independence payment after award of Child Disability Payment

15A.(1) Paragraphs (2), (3) and (4) apply where—

(a)C makes a claim for personal independence payment (“the new claim”);

(b)C had a previous award of child disability payment which ended not more than 2 years before the date on which the new claim is made; and

(c)C is aged 16 years or over at the date of the new claim.

(2) In relation to determination of entitlement under the new claim—

(a)the prescribed date for the purposes of regulations 12(1)(a) and (2)(a) and 13(1)(a) and (2)(a) is the date on which the previous award ended where that award was in respect of child disability payment; and

(b)regulations 12(1)(b) and (2)(b) and 13(1)(b) and (2)(b) have effect in relation to the new claim as if, for the words “the prescribed date” there were substituted “the date on which the new claim for personal independence payment is made”.

(3) Where C is awarded either or both components under the new claim, in relation to entitlement to that component or, as the case may be, those components, for the period of 3 months following the date of the new claim—

(a)the prescribed date for the purposes of regulations 12(1)(a) and (2)(a) and 13(1)(a) and (2)(a) is the date on which the previous award ended where that award was in respect of child disability payment; and

(b)regulations 12(1)(b) and (2)(b) and 13(1)(b) and (2)(b) have effect in relation to that award as if, for the words “the prescribed date” there were substituted “each day of the award”.

(4) C is to be regarded as meeting such of the conditions contained in the following provisions of these Regulations (as modified by paragraphs (2) and (3) above) as are relevant to C’s new claim, regardless of whether those conditions have been met—

(a)in regulation 12 (required period condition: daily living component), paragraph (1)(a) or (2)(a);

(b)in regulation 13 (required period condition: mobility component), paragraph (1)(a) or (2)(a)..

(7) In regulation 26 (claim for personal independence payment after an interval and after reaching the relevant age) in each of paragraphs (2)(c)(i), (2)(c)(ii) and (2)(d), after “the previous award” insert “of personal independence payment or adult disability payment”.

Amendment of the Employment and Support Allowance Regulations 2013

16.—(1) The Employment and Support Allowances Regulations 2013(18) are amended as follows.

(2) In regulation 94 (meaning of “person in hardship”)—

(a)in paragraph (3)(b)—

(i)after “child disability payment” for “or” substitute “,”;

(ii)after “personal independence payment”, insert “or adult disability payment”;

(b)in paragraph (3)(c)(ii)—

(i)after “child disability payment” for “or” substitute “,”;

(ii)after “personal independence payment”, insert “or adult disability payment”;

(c)in paragraph (7)—

(i)before the definition of “armed forces independence payment” insert—

Amendment of the Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Decisions and Appeals) Regulations 2013

17.—(1) The Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Decisions and Appeals) Regulations 2013(19) are amended as follows.

(2) In regulation 2(1) (interpretation)—

(a)omit the definition of “child disability payment”;

(b)after the definition of “the Rent Officers Order 2013” insert—

Scottish disability benefit” means, as the context requires, either of the following benefits—

(a)

adult disability payment within the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022; and

(b)

child disability payment within the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;.

(3) In regulation 12(b) (award of another benefit), for each occurrence of “child disability payment” substitute “Scottish disability benefit”.

(4) In paragraph 31 of Schedule 1 (effective dates for superseding decisions made on the ground of a change of circumstances), in sub-paragraphs (1), (2)(a)(i), (2)(a)(ii) and (2)(a)(iii), for each occurrence of “child disability payment” substitute “Scottish disability payment”.
