13.—(1) Section 30 of the Fisheries Act 1981(1) is amended as follows.
(2) For “retained EU”, in each place it appears, except in the definition of “retained EU restriction” in subsection (3), substitute “assimilated”.
(3) In subsection (3)—
(a)insert at the appropriate place—
““assimilated restriction” means a restriction that—
was created or arose by or under the EU Treaties before IP completion day, and
forms part of assimilated law,
as modified from time to time;”;
(b)omit the definition of “retained EU restriction”.
1981 c. 29; section 30 was amended by section 33 of, and paragraph 4 of Schedule 1 to, the Aquaculture and Fisheries (Scotland) Act 2007 (asp. 12), and section 51 of the Aquaculture and Fisheries (Scotland) Act 2013 (asp. 7), as it applies to Scotland. Section 30 was amended by regulation 3(4) of S.I. 2019/746 as it applies to England, Wales and Scotland. The amendments made by regulation 3 of S.I. 2019/746 were amended by regulation 2 of S.I. 2020/1599 before those amendments came into force. Section 30 was amended by regulation 3(5) of S.I. 2019/746 as it applies to Northern Ireland.
