2.—(1) Subject to paragraph (2), no person who is a qualified teacher shall be employed as a teacher at a school in Wales unless that person is registered in accordance with section 3 of the Teaching and Higher Education Act 1998(1), by the General Teaching Council for Wales.
(2) Paragraph (1) does not apply in relation to a person employed as a teacher at a school if that person is employed solely in the provision of –
(a)part-time education to persons over compulsory school age only; or
(b)full-time education to persons who have attained the age of 19 years only; or
(c)both such part-time and full-time education.
(3) In this regulation —
(a)“qualified teacher” has the same meaning as in section 218(2) of the Education Reform Act 1988(2);
(b)references to a person employed as a teacher include references to a person who is engaged to provide his or her services as a teacher otherwise than under a contract of employment; and
(c)references to a school are references:
(i)to a school maintained by a local education authority within the meaning of section 142(1) of the School Standards and Framework Act 1998(3); or
(ii)to a special school within the meaning of section 337(1) of the Education Act 1996(4) which is not so maintained.
At the time of making these Regulations, the regulations in force for Wales under this provision were the Education (Teachers' Qualifications and Health Standards) (Wales) Regulations 1999 (S.I. 1999/2817 (W.18)); at the time of making these Regulations, the regulations in force for England under this provision were the Education (Teachers' Qualifications and Health Standards) (England) Regulations 1999 (S.I. 1999/2166).
1996 c. 56; section 337(1) is amended by paragraph 80 of Schedule 30 to the School Standards and Framework Act 1998.
