Title, extent and commencement

1.  This Order may be cited as the Foot-And-Mouth Disease (Ascertainment of Value ) (Wales) Order 2001; it applies in relation to Wales and comes into force at 5pm on 22nd March 2001.

Ascertainment of value of an animal

2.—(1) For the purposes of paragraph 3(2) of Schedule 3 to the Animal Health Act 1981 the value of an animal slaughtered by the Minister because of foot-and-mouth disease shall be in accordance with this article.

(2) If the owner decides that he wishes to have the animal valued by a valuer, the value is the amount determined in writing by a valuer appointed jointly by the Minister and the owner of the animal or, failing such appointment, by a valuer appointed by the President of the Royal Institution of Chartered Surveyors.

(3) If the owner does not wish to have the animal valued by a valuer, the value is the amount set out for that animal in the Schedule.

(4) The valuer shall be paid by the Minister.

Explanatory Note

(This note is not part of the Order)

This Order establishes in Wales the system for ascertaining the value of animals slaughtered because of foot-and-mouth disease. The Schedule sets out fixed amounts of compensation if the owner does not choose to have the animals valued.

A Regulatory Appraisal has not been prepared.
