Mae Cynulliad Cenedlaethol Cymru, drwy arfer y pwerau a roddwyd iddo gan adrannau 16(1) a (3), 17(1), 18(1), 19(1)(b), 26, 45 a 48(1) o Ddeddf Diogelwch Bwyd 1990(1) a pharagraffau 1 a 4(b) o Atodlen 1 iddi, ar ôl iddo roi sylw yn unol ag adran 48A o'r Ddeddf honno i gyngor perthnasol a roddwyd gan yr Asiantaeth Safonau Bwyd ac ar ôl ymgynghori yn unol ag adran 48(4) a (4B) o'r Ddeddf honno, yn gwneud y Rheoliadau canlynol:

Enwi, cymhwyso a chychwyn

1.  Enw'r Rheoliadau hyn yw Rheoliadau Darpariaethau Arbelydru Bwyd (Cymru) 2001; maent yn gymwys i Gymru yn unig a deuant i rym ar 1 Mai 2001

Diwygiadau i Reoliadau Bwyd (Rheoli Arbelydru) 1990

2.  Diwygir Rheoliadau Bwyd (Rheoli Arbelydru) 1990 (2) i'r graddau y maent yn gymwys i Gymru yn unol â rheoliadau 3 i 16 isod.

3.  Ym mharagraff (1) o reoliad 2 (dehongli)—

(a)mewnosodir y diffiniadau canlynol yn union ar ôl y diffiniad o “the Agency”—

“Directive 1999/2” means the European Parliament and Commission Directive 1999/2/EC on the approximation of the laws of the Member States concerning foods and food ingredients treated with ionising radiation (3);

“Directive 1999/3” means the European Parliament and Commission Directive 1999/3/EC on the establishment of a Community list of foods and food ingredients treated with ionising radiation (4); a

(b)

yn y diffiniad o “ionising radiation”, yn lle'r geiriau “0.5 Gy” yn is-baragraff (a)(iii) rhoddir y geiriau “0.01 Gy in the case of inspection devices which utilise neutrons and 0.5 Gy otherwise” ac yn lle'r geiriau “and 5 MeV otherwise” rhoddir y geiriau “, 14 MeV in the case of neutrons and 5 MeV otherwise”.

5.  Yn rheoliad 6 (cyfyngu ar werthu), yn lle'r geiriau “Great Britain” rhoddir y gair “Wales”.

6.  Ar ôl rheoliad 6 mewnosodir y rheoliad canlynol—

Labelling of non-consumer foods

6A.(1) (a) In the case of foods subject to treatment by ionising radiation not intended for sale to the ultimate consumer or catering establishments the word “irradiated” or the words “treated with ionising radiation” shall be indicated on the documents which accompany or refer to those foods.

(b)Either the identity and address of the facility which carried out the irradiation, or the official reference number, shall be indicated on the documents referred to in sub-paragraph (a) above.

(2) In this regulation “ultimate consumer” and “catering establishment” have the meaning given in regulation 2(1) of the Food Labelling Regulations 1996 (5); and “the official reference number” is that referred to in Article 7.1 of Directive 1999/2..

7.  Yn rheoliad 7 (gweithgareddau sy'n digwydd yng Ngogledd Iwerddon)—

8.  Yn lle testun rheoliad 8 (amddiffyniad mewn perthynas ag allforion) rhoddir—

In any proceedings for an offence under these Regulations it shall be a defence for the person charged to prove that the food, in respect of which the offence is alleged to have been committed, was intended for export to a country which is not a member of the European Community, that that country had legislation analogous to these Regulations and that the food complies with such legislation..

9.  Yn Atodlen 1 (trwyddedau arbelydru), yn Rhan I (rhoi trwyddedau arbelydru), ym mharagraff 1—

(a)mewnosodir y geiriau “and how that would benefit consumers” ar ddiwedd is-baragraff (f)(i);

(b)mewnosodir yr is-baragraff canlynol rhwng is-baragraffau (f) a (g)—

(ff)in respect of each description of food specified pursuant to sub-paragraph (e) above, particulars demonstrating that his operation will be in conformity with Annex III to Directive 1999/2 and the Joint FAO/WHO Codex Alimentarius Commission Recommended International Code of Practice (6) for the operation of irradiation facilities used for the treatment of foods (in this Part of this Schedule referred to as “the Code of Practice”), reference FAO/WHO/CAC, vol. XV, edition 1,; ac

(c)mewnosodir yr is-baragraff canlynol rhwng is-baragraffau (g) ac (h)—

(gg)the identity, qualifications and position in his management structure of the person who has been designated to be responsible for compliance with the conditions necessary for application of the practices referred to in sub-paragraph (g) above,.

10.  Yn Atodlen 1, yn Rhan I, ym mharagraff 3(1)—

(a)yn union cyn is-baragraff (b) mewnosodir yr is-baragraff canlynol—

(aa)that the irradiation will be performed in conformity with the Code of Practice,;

(b)yn is-baragraff (g), ar ôl “paragraph 1(f)(iv) above” mewnosodir “are in conformity with Annex III to Directive 1999/2 and”;

(c)yn is-baragraff (h) hepgorir y gair “and” ar y diwedd;

(ch)ar ôl is-baragraff (i) ychwanegir y canlynol—

and

(j)that the irradiation will be of benefit to the consumer,; a

(d)yn y geiriau terfynol , yn lle “paragraphs (a) to (i) above” rhoddir “sub-paragraphs (a) to (j) above”.

11.  Yn Atodlen 1, yn Rhan II (telerau ac amodau trwyddedau arbelydru)—

(a)ym mharagraff 9(1) mewnosodir ar y dechrau y geiriau “The licence shall prohibit the licensee from subjecting any food to treatment by ionising radiation in combination with any chemical treatment having the same purpose as that treatment.” ;

(b)rhoddir y rhif “(1)” i gynnwys paragraff 15 ac ychwanegir yr is-baragraff canlynol—

(2) The licence shall require the licensee to preserve the records referred to in sub-paragraph (1) for a period of 5 years after making.;

(c)yn lle paragraff 16(1) rhoddir y canlynol—

(1) The licence shall require the licensee to send to the licensing authority within twenty eight days after each anniversary of the date from which the licence runs a written return in respect of the year ending with that anniversary.; ac

(ch)yn lle paragraff 18 (parhad) rhoddir y canlynol—

Duration

18.  The licence shall, subject to Part III below, continue in effect unless withdrawn or suspended in accordance with the provisions of Part IV below or surrendered by the licensee to the licensing authority; and existing licenses shall be construed accordingly..

12.  Yn Atodlen 1, yn Rhan III (amrywio trwydded arbelydru), yn lle paragraff 1(1) rhoddir y canlynol—

(1) The licensing authority and the licensee may, subject to paragraph 2 below, agree between themselves, on payment by the licensee to the licensing authority of the appropriate variation agreement charge, to vary—

(a)the term of the licence inserted by virtue of paragraph 4 of Part II above (7), but only if the licence will if so varied apply to the same one or more of the seven permitted descriptions of food that it did prior to the variation; and in deciding whether or not to agree to vary that term the licensing authority shall consider whether it is satisfied that the conditions of the licence inserted by virtue of paragraph 5 or 6 of Part II above are appropriate to the new description of food, or should be varied, and whether any new conditions should be inserted; or

(b)any condition of a licence inserted by virtue of paragraph 5 or 6 of Part II above..

13.  Yn Atodlen 1, yn Rhan IV (tynnu trwydded arbelydru yn ôl, ei hatal a'i hestyn)—

(i)yn y pennawd “Withdrawal, suspension and extension of irradiation licence” yn lle'r geiriau “, suspension and extension” rhoddir y geiriau “and suspension”, a

(ii)diddymir paragraffau 4 a 5.

14.  Yn Atodlen 1, yn Rhan VI (ffioedd)—

(a)yn lle paragraff 2 rhoddir y canlynol—

2.  For the purposes of this Schedule—

(a)the amount of the application consideration charge is £5,000 plus—

(i)if more than one description of food is specified by virtue of paragraph 1(e) of Part I above, a sum (fixed at the discretion of the licensing authority) no greater than £1,500 × A where A is one less than the number of descriptions of food so specified; and

(ii)if the application (however many descriptions of food the application relates to) falls within paragraph 3(3) of Part I above, a sum (fixed at the discretion of the licensing authority) no greater than the sum which would otherwise have been payable in respect of the original application;

(b)the amount of the inspection charge is £750 for each inspection carried out in respect of which an inspection charge is payable; and

(c)the amount of the variation agreement charge is—

(i)in the case of a variation pursuant to paragraph 1(1) (a) of Part III above whereby the licence, if varied, will apply to a description of food not specified in the term of the licence inserted by virtue of paragraph 4 of Part II above which specifies each description of food to which the licence applies, a sum (fixed at the discretion of the licensing authority) no greater than £1,500 × (B − C) where B is the number of descriptions of food to which the licence, if varied, will apply and C is the number of descriptions of food specified in the term, and

(ii)£500 in any other case.;

(b)yn is-baragraff (b) o baragraff 3—

(i)yn lle'r geiriau “other than a pure continuation licence, £1,800” ym mharagraff (i) rhoddir “, £1,500”, a

(ii)yn lle “£2,700” ym mharagraff (ii) rhoddir “£2,250”.

15.  Yn lle Atodlen 2 (mewnforio bwyd) rhoddir y canlynol—

Regulation 4

SCHEDULE 2IMPORTATION OF FOOD

PART I : IMPORTATION FROM OTHER MEMBER STATES

1.  This Part applies to the importation of food irradiated in other Member States.

2.  For the purposes of regulation 4—

(a)“recognised appropriate origin” means origin in a plant, authorised by the Competent Authority of that State, which is listed in the Official Journal of the European Communities pursuant to article 7.4 of Directive 1999/2; and

(b)“appropriate documentation” means documentation containing the information referred to in regulation 6A(1)(b).

PART II : IMPORTATION FROM THIRD COUNTRIES

1.  This Part applies to the importation of food irradiated in a country (or territory) outside the European Community.

2.  In the case of herbs and spices, for the purposes of regulation 4—

(a)“recognised appropriate origin” means origin in a plant approved pursuant to Article 9 of Directive 1999/2, and listed in the Official Journal of the European Communities pursuant to that Article; and

(b)“the appropriate documentation” means the documents referred to in the second indent of paragraph 1 of the said Article 9.

3.  In the case of food other than herbs and spices—

(1) Recognition of appropriate origin shall be effected by publication by the Agency of a notice in the London Gazette declaring that an origin is an appropriate origin for the purposes of these Regulations.

(2) “Origin” means, in relation to a country or territory specified in the notice, origin in that country or territory.

(3) Recognition of appropriate origin may not be effected by the Agency in respect of any country or territory unless it is satisfied—

(a)that in that country or territory food which is subjected to treatment by ionising radiation may only be so subjected if the person who subjects it has a current irradiation licence granted, under a reference by which that licence can be identified, by a competent authority in that country or territory,

(b)that any irradiation licence granted in that country or territory includes provision for an approved method of measurement relating to food to which the licence relates, and

(c)that the operation of the legislation in force in that country relating to the subjection there of food to treatment by ionising radiation protects human health to an extent not less than human health is protected by operation of these Regulations.

(4) If the Agency ceases to be satisfied of the matters specified in sub-paragraphs (a), (b) and (c) of sub-paragraph (2) above in respect of an origin in a country or territory it may publish in the London Gazette notice that, as from a date specified in the notice, that origin shall not longer be an appropriate origin for the purposes of these Regulations and, if such a notice is published, the recognition of appropriate origin shall cease to have effect on that date.

Appropriate documentation

(5) Appropriate documentation for food other than herbs and spices for the purposes of these Regulations is a statement to the effect that the food has been subjected to treatment by ionising radiation together with—

(a)a copy of all the particulars a copy of which, by virtue of sub-paragraphs (a) to (d) of paragraph 15(1) of Part II of Schedule 1 above, would be required to accompany any food had it been consigned by the holder of an irradiation licence to any other person after subjection by him to treatment by ionising radiation, and

(b)confirmation from the holder of the irradiation licence in the country in which the food was subjected to treatment by ionising radiation that the irradiation licence was in effect in relation to the food at the time at which that treatment took place.

16.  Yn Atodlen 3 (gofynion storio a chludo)—

(a)ym mharagraffau 2 a 4, yn lle “Great Britain” rhoddir ym mhob achos “Wales”; a

(b)ym mharagraff 4, ar ôl “Northern Ireland” mewnosodir, “ Scotland and England”.

Diwygiadau i Reoliadau Labelu Bwyd 1996

17.  Diwygir Rheoliadau Labelu Bwyd 1996 i'r graddau y maent yn gymwys i Gymru yn unol â rheoliadau 18 i 24 isod.

18.  Ym mharagraph (1) o reoliad 2 (dehongli)—

(a)ar ôl y diffiniad o “Directive 94/54” rhoddir y diffiniad canlynol—

“Directive 99/2” means European Parliament and Council Directive 1999/2/EC on the approximation of the laws of the Member States concerning foods and food ingredients treated with ionising radiation;; a

(b)yn y diffiniad o “ionising radiation”, yn lle'r geiriau “0.5 Gy” yn is-baragraff (c) rhoddir y geiriau “0.01 Gy in the case of inspection devices which utilise neutrons and 0.5 Gy otherwise”, ac yn lle'r geiriau “and 5 MeV otherwise” rhoddir y geiriau “, 14 MeV in the case of neutrons and 5 MeV otherwise”.

19.  Ym mharagraff (1)(iv) o reoliad 3 (esemptiadau), yn lle'r geiriau “and Directive 94/54” rhoddir y geiriau “,Directive 94/54 and Directive 99/2”.

20.  Yn lle paragraff (4)(b) o reoliad 15 (cynhwysion cyfansawdd) rhoddir—

(b)the compound ingredient constitutes less than 25 per cent of the finished product, except that—

(i)subject to regulation 17, any additive which is an ingredient of such a compound ingredient shall be named in the list of ingredients in accordance with paragraph (2) of this regulation; and

(ii)where an ingredient of such a compound ingredient has been irradiated the name of that ingredient and the words required by paragraph 2 of Schedule 2 shall be given, except in the case of food which is prepared for patients requiring sterile diets under medical supervision..

21.  Mewnosodir y paragraffau canlynol rhwng paragraffau (4) a (5) o reoliad 26 (pecynnau bach a photeli penodol sydd wedi'u marcio'n annileadwy)—

(4A) Any food which—

(a)by virtue of paragraph (1) or (3) of this regulation alone is exempted from the requirement to be marked or labelled with a list of ingredients;

(b)contains any ingredient which has been irradiated; and

(c)is not prepared for patients requiring sterile diets under medical supervision,

shall be marked or labelled with an indication that it contains that ingredient, and in such a case the reference within that indication to that ingredient shall include or be accompanied by the word “irradiated” or the words “treated with ionising radiation”..

22.  Yn rheoliad 35 (gofyniad cyffredinol ynghylch dull marcio neu labelu bwyd heblaw bwyd y mae rheoliad 23, 27 neu 31 yn gymwys iddo)—

(a)rhoddir y rhif “(1)” i'r testun presennol;

(b)yn y geiriau terfynol i baragraff (1), ar ôl y gair “may” rhoddir y geiriau “(except as provided in paragraph (2) of this regulation)”; ac

(c)rhoddir y paragraff canlynol yn union ar ôl paragraff (1)—

(2) In the case of food to which paragraph (1) of this regulation applies which has been irradiated, other than food which is prepared for patients requiring sterile diets under medical supervision, the alternative provided in the full-out words to that paragraph shall not apply as regards the particulars specified in regulations 14(2) and 26(4A) and paragraph 2 of Schedule 2, and the word “irradiated” or the words “treated with ionising radiation” shall in all cases appear on the commercial documents relating to such food.

23.  Yn rheolaid 36 (dull marcio neu labelu bwyd y mae rheoliad 23 neu 27 yn gymwys iddo)—

(a)yn union ar ôl paragraff (1) rhoddir y paragraff canlynol—

(1A) Paragraphs (2) to (4) of this regulation shall apply only to food which is prepared for patients requiring sterile diets under medical supervision.;

(b)ym mharagraff (5), yn is-baragraff (c) mewnosodir ar y dechrau yr ymadrodd “(except as provided in paragraph (6) of this regulation)”; ac

(c)ychwanegir y paragraffau canlynol ar y diwedd—

(6) Notwithstanding the foregoing paragraphs of this regulation (but subject to paragraph (7) of the same), in the case of the sale of any food to which regulation 23 or 27 applies which has been irradiated—

(a)the word “irradiated” or the words “treated with ionising radiation” shall in all cases appear on the commercial documents relating to such food; and

(b)sub-paragraph (c) of paragraph (5) of this regulation shall not apply as regards the particulars specified in regulations 14(2), 25(1) and 27(3) and (4) and paragraph 2 of Schedule 2.

(7) Paragraph (6) of this regulation shall not apply in relation to food which is prepared for patients requiring sterile diets under medical supervision..

24.  Yn is-baragraff (b) o reoliad 47 (amddiffyniad mewn perthynas ag allforio), yn lle'r geiriau “and Directive 94/54” rhoddir y geiriau “,Directive 94/54 and Directive 99/2”.

1.  Mae'r Rheoliadau hyn yn rhoi eu heffaith i'r canlynol ar waith yng Nghymru—

(a)Cyfarwyddeb 1999/2/EC Senedd Ewrop a'r Cyngor ynghylch cyd-ddynesiad cyfreithiau'r Aelod-wladwriaethau ar fwydydd a chynhwysion bwydydd sydd wedi'u trin ag ymbelydredd ïoneiddio (OJ Rhif L66, 13.3.99, t.16); a

(b)Cyfarwyddeb 1999/3/EC Senedd Ewrop a'r Cyngor ynghylch sefydlu rhestr Gymunedol o fwydydd a chynhwysion bwydydd sydd wedi'u trin ag ymbelydredd ïoneiddio (OJ Rhif L66, 13.3.99, t.24).

2.  Mae'r Rheoliadau hyn yn rhoi eu heffaith i'r darpariaethau uchod drwy ddiwygio'r Rheoliadau canlynol i'r graddau y maent yn gymwys i Gymru—

(a)Rheoliadau Bwyd (Rheoli Arbelydru) 1990 (OS 1990/2490), fel y'u diwygiwyd; a

(b)Rheoliadau Labelu Bwyd 1996 (OS 1996/1499), fel y'u diwygiwyd.

3.  Mae Rheoliadau Bwyd (Rheoli Arbelydru) 1990 a Rheoliadau Labelu Bwyd 1996 yn gymwys i Brydain Fawr gyfan.

4.  Mae'r diwygiadau o sylwedd i Reoliadau Bwyd (Rheoli Arbelydru) 1990 fel a ganlyn—

(a)mae diffiniadau o Gyfarwyddebau 1999/2/EC a 1999/3/EC yn cael eu mewnosod yn rheoliad 2(1) (rheoliad 3(a));

(b)mae'r diffiniad o “ionising radiation” yn rheoliad 2(1) yn cael ei ddiwygio (rheoliad 3(b));

(c)mae rheoliad newydd, 6A, yn cael ei fewnosod, yn ei gwneud yn ofynnol bod bwydydd nad ydynt ar gyfer defnyddwyr ac sy'n cael eu trin ag ymbelydredd ïoneiddio yn cael eu labelu (rheoliad 6);

(ch)mae testun rheoliad 8 (amddiffyniad mewn perthynas ag allforio) yn cael ei ddiwygio (rheoliad 8). Erbyn hyn, mewn perthynas â bwyd y bwriedir ei allforio i wlad nad yw'n aelod o'r Gymuned Ewropeaidd yn unig y mae'r amddiffyniad yn gweithredu;

(e)mae'r telerau a'r amodau a nodir yn Rhan II o Atodlen 1 (telerau ac amodau sydd i'w cynnwys mewn trwyddedau arbelydru) yn cael eu hamrywio (rheoliad 11);

(f)mae pwer yn cael ei roi i'r awdurdod trwyddedu a'r trwyddegid i gytuno ar amrywiad yn un o delerau trwydded arbelydru a fewnosodir yn rhinwedd paragraff 4 o Ran II o Atodlen 1 (rheoliad 12);

(ff)mae'r pwer i estyn trwydded arbelydru, a geir ar hyn o bryd yn Rhan IV o Atodlen 1 yn cael ei ddiddymu (rheoliad 13);

(g)mae paragraff 2 diwygiedig o Ran VI o Atodlen 1 (sy'n pennu swm pob ffi y cyfeirir ati yn yr Atodlen honno) yn cael ei roi yn lle paragraff 2 presennol y Rhan honno, sydd hefyd yn pennu swm pob ffi y cyfeirir ati yn Atodlen 1 (rheoliad 14(a));

5.  Mae'r Rheoliadau hyn hefyd yn gwneud rhywfaint o ddiwygiadau canlyniadol i Reoliadau Bwyd (Rheoli Arbelydru) 1990.

6.  Dyma'r diwygiadau i'r Rheoliadau Labelu Bwyd—

(a)mae diffiniad o Gyfarwyddeb 1999/2/EC yn cael ei fewnosod yn rheoliad 2(1) (rheoliad 18(a));

(b)mae'r diffiniad o “ionising radiation” yn rheoliad 2(1) yn cael ei ddiwygio (rheoliad 18(b));

(c)mae'r esemptiad yn rheoliad 3(1) ar gyfer bwyd y deuir ag ef i Prydain Fawr o dan amgylchiadau penodol o Aelod-wladwriaeth arall neu o un o wladwriaethau'r Ardal Economaidd Ewropeaidd yn cael ei addasu er mwyn ei gwneud yn ofynnol bod bwyd o'r fath yn cydymffurfio (os yw'n gymwys) â Chyfarwyddeb 1999/2/EC (rheoliad 19);

(ch)mae is-baragraff (b) diwygiedig o reoliad 15(4) (yn darparu eithriad i'r gofyniad bod enwau cynhwysion cynhwysyn cyfansawdd a ddefnyddir i baratoi bwyd yn gorfod cael eu rhoi yn y rhestr o gynhwysion y bwyd) yn cael ei roi yn lle'r is-baragraff (b) presennol o reoliad 15(4) (rheoliad 20);

(d)mae rheoliad 26 (pecynnau bach a photeli penodol sydd wedi'u marcio'n annileadwy) yn cael ei ddiwygio i'w gwneud yn ofynnol bod bwyd penodol sydd, er ei fod wedi'i esemptio o'r gofyniad i gael ei farcio neu ei labelu â rhestr o gynhwysion, yn cynnwys cynhwysyn sydd wedi'i arbelydru, yn cael ei farcio a'i labelu yn unol â hynny (rheoliad 21);

(dd)mae rheoliad 35 (sy'n gosod gofyniad cyffredinol ynghylch dull marcio neu labelu bwydydd penodol) yn cael ei ddiwygio fel bod y dewis arall yn lle'r gofyniad hwnnw a geir ar ddiwedd y rheoliad hwnnw yn cael ei ddiwygio yn achos categori penodedig o'r bwyd hwnnw sydd wedi'i arbelydru (rheoliad 22);

(e)mae rheoliad 36 (sy'n gosod gofyniad ynghylch dull marcio neu labelu bwydydd penodol eraill) yn cael ei ddiwygio fel bod—

(i)cymhwyso paragraffau (2) i (4) o'r rheoliad hwnnw (sy'n caniatáu defnyddio labeli gwahanol yn achos bwyd penodol sydd wedi bod yn gynhwysyn a arbelydrwyd neu sy'n cynnwys un) yn cael ei gyfyngu i fwyd sy'n cael ei baratoi ar gyfer cleifion y mae arnynt angen deiet sterilaidd o dan oruchwyliaeth feddygol, a

(ii)yn achos gwerthu bwyd y mae rheoliad 23 neu 27 o OS 1996/1499 yn gymwys iddo ac sydd wedi'i arbelydru (heblaw bwyd a baratoir ar gyfer cleifion y mae arnynt angen deiet sterilaidd o dan oruchwyliaeth feddygol), bod rhaid i'r dogfennau masnachol sy'n ymwneud â'r bwyd ddangos ym mhob achos ei fod wedi'i arbelydru (rheoliad 23); ac

(f)mae'r amddiffyniad mewn perthynas ag allforion (rheoliad 47) yn cael ei ddiweddaru i gynnwys cyfeiriad at Gyfarwyddeb 1999/2/EC (rheoliad 24).
