The National Assembly for Wales and the Minister of Agriculture, Fisheries and Food, acting jointly in exercise of the powers conferred on them by sections 1, 8 and 17(1) of the Animal Health Act 1981(1) and of all other powers enabling them in that behalf, make the following Order:

Title, application and commencement

1  This Order may be cited as the Foot-and-Mouth Disease (Amendment) (Wales) (No. 5) Order 2001; it applies to Wales and shall come into force at 11 p.m. on 6th April 2001.

Amendment to the Foot-and-Mouth Disease Order 1983

2—(1) The Foot-and-Mouth Disease Order 1983(2) is amended in accordance with the following provisions of this article.

(2) In article 31(2)(a), the words “sheep, cattle or pigs” are replaced by the word “animals”.

(3) In Schedule 5, paragraph 1 of the “Conditions of Licence” is replaced by the following paragraph—

1.  Before being moved, animals to which this licence relates shall be marked as follows:—

  • CATTLE (including water buffalo and bison): A broad arrow, 15 cm long, clipped on left hindquarter, and hair clipped off end of tail.

  • SHEEP AND GOATS: A single red stripe, 30 cm long and 2 cm wide, painted with adhesive composition, or in such manner that it will remain legible for the entire length of the journey, down the centre of the animal’s back.

  • PIGS AND WILD BOAR: A single red stripe, 30 cm long and 2 cm wide, painted with adhesive composition, or in such manner that it will remain legible for the entire length of the journey, down the centre of the animal’s back.

  • DEER: A single red stripe, 60 cm long and at least 5 cm wide, painted with adhesive composition, or in such manner that it will remain legible for the entire length of the journey, down the centre of the back.

Explanatory Note

(This note is not part of the Order)

This Order, which applies to Wales, amends the Foot-and-Mouth Disease Order 1983 (S.I. 2001/1950, as amended) by extending the categories of animals within a controlled area (declared by Part IV of that Order) that can be moved to slaughter under licence. The animals that can now be moved include: all cattle, sheep, goats, other ruminating animals and swine (including wild boar).
