The Countryside and Rights of Way Act 2000 (Commencement No. 1) (Wales) Order 2001

The National Assembly for Wales makes the following Order in exercise of the powers conferred on it by section 103(3) of the Countryside and Rights of Way Act 2000(1).

Citation, interpretation and application

1.—(1) This Order may be cited as the Countryside and Rights of Way Act 2000 (Commencement No. 1) (Wales) Order 2001.

(2) In this Order “the Act” means the Countryside and Rights of Way Act 2000.

(3) This Order applies to Wales.

Appointed day

2.  30 January 2001 is the appointed day on which section 99 of the Act shall come into force.

Explanatory Note

(This note does not form part of the Order)

This Order brings section 99 of the Countryside and Rights of Way Act 2000 (“the Act”) into force on 30th January 2001.

Section 103(3) of the Act gives the National Assembly for Wales the power to appoint the day on which a provision not brought into force automatically by the Act shall come into force. Section 99 of the Act is a provision to which section 103(3) applies and provides—

(a)with regard to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), for the references to the Highways Act 1980 and the Wildlife and Countryside Act 1981 in Schedule 1 to that Order to be read as referring to those Acts as amended by the Act; and

(b)for Schedule 11 to the Act to be added to Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999. This will enable the functions of the Secretary of State contained in Schedule 11 to the Act to be exercisable by the National Assembly for Wales.
