The National Assembly for Wales makes the following Order in exercise of the powers conferred on the appropriate Minister by section 26(2) of the Welsh Language Act 1993(1) and now vested in the National Assembly for Wales:

Citation and Commencement

1.  This Order may be cited as the National Assembly for Wales (Elections : Nomination Papers) (Welsh Form) Order 2001 and shall come into force on 16th August 2001.

Welsh Form

2.—(1) “Annibynnol” is hereby prescribed as the form of words in Welsh for the word “Independent” which is specified by section 22(3)(a)(i) of the Political Parties, Elections and Referendums Act 2000(2).

(2) The form of words in Welsh which is prescribed by paragraph (1) may be used as well as or in place of the equivalent word in English at an election to the National Assembly for Wales.

Explanatory Note

(This note is not part of the Order)

The Order, which comes into force on 16th August 2001, applies to elections to the National Assembly for Wales.

Section 22 of the Political Parties, Elections and Referendums Act 2000 (c. 41) makes provision for parties to be registered in order to field candidates at “relevant elections” (which by virtue of section 22(5)(d) includes elections to the National Assembly). It does so by providing that a person may only stand as a candidate at such an election if that candidate’s nomination paper is accompanied by a certificate authorising his candidature issued by, or on behalf of, the nominating officer of a qualifying registered party or if his nomination paper either gives the description “Independent” or gives no description whatsoever.

This Order provides that, in relation to an election to the National Assembly for Wales, “Annibynnol” is prescribed as the form of words in Welsh for the word “Independent” for use as the description of the candidate in the nomination paper.

1993 c. 38. For the meaning of “the appropriate Minister” see section 27(4) of the Welsh Language Act 1993. By the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) (to which there are amendments not relevant to the Order) the cited function of “the appropriate Minister” was, so far as exercisable in relation to Wales, made exercisable by the National Assembly for Wales concurrently with any Minister of the Crown by whom that power was exercisable.
