Drwy arfer y pwerau a roddwyd i'r Ysgrifennydd Gwladol gan adrannau 527A(4) a (5) a 569(4) a (5) o Ddeddf Addysg 1996(1) ac sydd wedi'u breinio bellach yng Nghynulliad Cenedlaethol Cymru(2), mae Cynulliad Cenedlaethol Cymru drwy hyn yn gwneud y Rheoliadau canlynol:

Enwi, cychwyn a chymhwyso

1.—(1) Enw'r Rheoliadau hyn yw Rheoliadau Awdurdodau Addysg Lleol (Cynlluniau Cymorth Ymddygiad) (Diwygio) (Cymru) 2001 a deuant i rym ar 1 Ebrill 2001.

(2) Mae'r Rheoliadau hyn yn gymwys yng Nghymru yn unig.

Diwygio Rheoliadau

2.  Yn rheoliad 3 (ymgynghori) o Reoliadau Awdurdodau Addysg Lleol (Cynlluniau Cymorth Ymddygiad) 1998(3) —

(i)Ym mharagraff (2)(n) yn lle'r geiriau “clerk to the justices” rhoddir y geiriau “justices' chief executive”; a

(ii)Dilëir paragraff (5) .

(Nid yw'r nodyn hwn yn rhan o'r Rheoliadau)

Mae'r Rheoliadau hyn yn diwygio Rheoliadau Awdurdodau Addysg Lleol (Cynlluniau Cymorth Ymddygiad) 1998 mewn perthynas â Chymru i drosglwyddo swyddogaethau gweinyddol clercod ustusiaid i brif weithredwyr ustusiaid yn unol ag adran 90 o Ddeddf Cyfle i Gael Cyfiawnder 1999 (p.22) ac Atodlen 13 iddi.

Mae is-adran (5) o'r adran honno yn darparu mai holl swyddogaethau clercod ustusiaid yw eu swyddogaethau gweinyddol at ddibenion yr adran honno ar wahân i'r rhai sy'n swyddogaethau cyfreithiol o fewn yr ystyr a roddir iddynt gan adran 48(2) o Ddeddf Ynadon Heddwch 1997 (p.25), fel y'i hamnewidiwyd gan adran 89(1) o Ddeddf 1999.
