Mae Cynulliad Cenedlaethol Cymru, drwy arfer y pwerau a roddwyd gan adrannau 16(1)(e) ac (f), 17(1), 26(1) a (3) a 48(1) o Ddeddf Diogelwch Bwyd 1990(1) ac sydd yn awr wedi'u breinio ynddo(2), ac yntau wedi rhoi sylw yn unol ag adran 48(4A) o'r Ddeddf honno i gyngor perthnasol a roddwyd gan yr Asiantaeth Safonau Bwyd ac ar ôl ymgynghori fel sy'n ofynnol gan erthygl 9 o Reoliad (EC) Rhif 178/2002 Senedd Ewrop a'r Cyngor(3) sy'n gosod egwyddorion a gofynion cyffredinol cyfraith fwyd, yn sefydlu Awdurdod Diogelwch Bwyd Ewropeaidd ac yn gosod gweithdrefnau mewn materion sy'n ymwneud â diogelwch bwyd ac yn unol ag adran 48(4) a (4B) o'r Ddeddf honno, yn gwneud y Rheoliadau canlynol:

Enw, cychwyn a chymhwyso

1.  Enw'r Rheolidau hyn yw Rheoliadau Labelu Bwyd (Diwygio) (Cymru) 2003; deuant i rym ar 24 Mawrth 2003 ac maent yn gymwys i Gymru yn unig.

Diwygio Rheoliadau Labelu Bwyd 1996

2.  Caiff Rheoliadau Labelu Bwyd 1996(4)) eu diwygio (i'r graddau y maent yn gymwys i Gymru) yn unol â rheoliadau 3 i 5.

3.  Yn rheoliad 14 (enwau cynhwysion) yn lle paragraff (4) rhoddir y paragraff canlynol —

(4) A generic name which is listed in or referred to in column 1 of Part I of Schedule 3 may be used for an ingredient which is specified in the corresponding entry in column 2 of that Part of that Schedule in accordance with any conditions that are laid down in the corresponding entry in column 3 of that Part of that Schedule..

4.  Yn Rheoliad 50 (darpariaeth drosiannol) mewnosodir ar y diwedd y paragraff canlynol —

(10) In any proceedings for an offence under regulation 44(1)(a), it shall be a defence to prove that —

(a)the food concerned was sold before 1st July 2003 or marked or labelled before that date; and

(b)the matters constituting the offence would not have constituted an offence under these Regulations if the amendments made by regulations 3 and 5 of the Food Labelling (Amendment) (Wales) Regulations 2003 had not been in operation when the food was sold, marked or labelled..

PART I

GENERAL;

(b)yn dilyn y cyfeiriadau at berlysieuyn, perlysiau neu berlysiau cymysg mewnosodir colofn 1 (enw generig), colofn 2 (cynhwysion) a cholofn 3 (amodau defnyddio enw generig)) yn y drefn honno —

“Meat” and the name of the animal species from which it comes, or a word which describes the meat by reference to the animal species from which it comes

Any skeletal muscle, including the diaphragm and the masseters, of a mammalian or bird species recognised as fit for human consumption with any naturally included or adherent tissue, but excluding —

(a)

the heart,

(b)

the tongue,

(c)

the muscles of the head (other than the masseters),

(d)

the muscles of the carpus,

(e)

the tarsus,

(f)

the tail, and

(g)

any products covered by the definition of “mechanically recovered meat” Article 2(c) of Council Directive 64/433/EEC(6) on health conditions for the production and marketing of fresh meat, as last amended by Council Directive 95/23/EC(7).

The total fat and connective tissue content must not exceed the limits specified in Part II of this Schedule and the meat must constitute an ingredient of another food. If such a limit is exceeded, but the ingredient falls within the description in column 2 of this entry, any reference to the meat content must be adjusted downwards accordingly and the list of ingredients must also mention the presence of fat or connective tissue, as appropriate.;

(Nid yw'r nodyn hwn yn rhan o'r Rheoliadau)

1.  Mae'r Rheoliadau hyn yn diwygio Rheoliadau Labelu Bwyd 1996, fel y'u diwygiwyd (“y prif Reoliadau”) i'r graddau y maent yn gymwys i Gymru. Mae'r Rheoliadau hynny yn cwmpasu Prydain Fawr yn ei chyfanrwydd.

2.  Mae'r Rheoliadau hyn yn gweithredu yng Nghymru Gyfarwyddeb y Comisiwn 2001/101/EC (OJ Rhif L310, 28.11.2001, t.19) sy'n diwygio Cyfarwyddeb 2000/13/EC Senedd Ewrop a'r Cyngor ar gyd-ddynesiad cyfreithiau Aelod-wladwriaethau sy'n ymwneud â labelu, cyflwyno a hysbysebu bwydydd. Mae'r Rheoliadau yn caniatáu defnyddio'r term generig “meat” gydag enw rhywogaeth yr anifail y mae'n tarddu ohono (neu dermau cyfatebol megis “pork” neu “beef”) ar gyfer cyhyrau ysgerbydol rhywogaethau mamalaidd a rhywogaethau adar mewn rhestrau cynhwysion, yn ddarostyngedig i amodau penodol (rheoliadau 2, 3 a 5). Mae'r rheolau yn rheoliad 19 o'r prif Reoliadau ar ddynodi swmp cynhwysion neu gategorïau penodol o gynhwysion yn gymwys mewn perthynas â'r enw generig hwnnw. Mae'r Rheoliadau hyn hefyd yn mewnosod darpariaeth drosiannol mewn perthynas â'r enw generig hwnnw er mwyn rhoi ar waith Gyfarwyddeb 2002/86/EC ar gyfer bwyd sy'n cael ei werthu, ei farcio neu ei labelu cyn 1 Gorffennaf 2003 (rheoliad 4).

3.  Paratowyd arfarniad rheoliadol a'i osod yn Llyfrgell Cynulliad Cenedlaethol Cymru ynghyd â Nodyn Trawsosod yn nodi sut y mae prif elfennau Cyfarwyddeb 2001/101/EC a Chyfarwyddeb 2002/86/EC i gael eu trawsosod yn y Rheoliadau hyn. Gellir cael copïau oddi wrth yr Asiantaeth Safonau Bwyd, Llawr 1, Ty Southgate, Wood Street, Caerdydd, CF10 1EW.
