Rhedeg yr ysgol cyn dyddiad agor yr ysgol

30.—(1) Yn ddarostyngedig i baragraff (2), mae adran 61 o Ddeddf 1998 ac adrannau 27 a 28 o Ddeddf 2002, ac Atodlen 1 iddi yn gymwys mewn perthynas ag ysgol arfaethedig(1) gyda'r addasiadau canlynol—

(a)mae cyfeiriadau at gorff llywodraethu i'w trin fel cyfeiriadau at gorff llywodraethu dros dro;

(b)mae cyfeiriadau at ysgol a gynhelir i'w trin fel pe baent yn cynnwys cyfeiriad at ysgol a gynhelir arfaethedig;

(c)mae cyfeiriadau at yr offeryn llywodraethu i'w trin fel cyfeiriadau at yr offeryn llywodraeth p'un a yw wedi dod yn effeithiol neu beidio; ac

(ch)nid yw adrannau 61(3)(b) a (7) o Ddeddf 1998 a pharagraff 2(2) a (3) o Atodlen 1 i Ddeddf 2002 yn gymwys.

(2) Ni chaiff corff llywodraethu dros dro ysgol arfaethedig nad oes ganddi gyllideb ddirprwyedig arfer unrhyw rai o'r pwerau a nodir ym mharagraff 3 (3)(b) i (f) o Atodlen 1 i Ddeddf 2002 (fel y'i haddaswyd) heb yn gyntaf cael cytundeb ysgrifenedig—

(a)yr awdurdod addysg lleol yn achos ysgol arfaethedig a fydd yn ysgol gymunedol, ysgol wirfoddol a reolir, ysgol arbennig gymunedol neu ysgol arbennig sefydledig, ysgol feithrin a gynhelir neu ysgol sefydledig y cafodd y cynigion ar gyfer ei sefydlu eu cyhoeddi gan awdurdod addysg lleol, neu

(b)yr hyrwyddwyr yn achos ysgol arfaethedig a fydd yn ysgol wirfoddol a gynorthwyir neu ysgol sefydledig y cafodd y cynigion ar gyfer ei sefydlu eu cyhoeddi gan hyrwyddwyr.

At ddibenion adran 30(3) o'r Ddeddf honno ac adrannau 495 i 498 o Ddeddf 1996, mae adran 34(7) o Ddeddf 2002 yn darparu bod y corff llywodraethu dros dro i gael ei drin fel pe bai'n gorff llywodraethu ar unrhyw adeg cyn dyddiad agor yr ysgol.
