Tramgwyddau a chosbau

39.—(1) Bydd unrhyw berson sydd—

(a)yn mynd yn groes i baragraff (5) o reoliad 26, rheoliad 27 neu baragraff (4) neu (5) o reoliad 33, neu sy'n methu â chydymffurfio â hwy; neu

(b)yn methu â chydymffurfio â hysbysiad a gyflwynwyd i'r person hwnnw o dan y Darpariaethau Mewnforio,

yn euog o dramgwydd.

(2) Yn ddarostyngedig i baragraff (3), bydd person sy'n euog o dramgwydd o dan y Darpariaethau Mewnforio yn agored—

(a)o'i gollfarnu'n ddiannod, i ddirwy nad yw'n fwy na'r uchafswm statudol; neu

(b)o'i gollfarnu ar dditiad, i garchariad am gyfnod nad yw'n hwy na dwy flynedd, i ddirwy neu i'r ddau.

(3) Bydd person sy'n euog o dramgwydd o dan reoliad 38 yn agored, o'i gollfarnu'n ddiannod, i ddirwy nad yw'n uwch na lefel 5 ar y raddfa safonol neu i garchariad am gyfnod nad yw'n hwy na thri mis, neu i'r ddau.
