Canlyniadau methu â chyflwyno hysbysiad trosglwyddo yn briodol

17.—(1) mae'r rheoliad hwn yn gymwys os na chyflwynir hysbysiad trosglwyddo yn briodol yn unol â rheoliad 9 neu 13.

(2) Ni ddylid trin unrhyw gwota nas defnyddiwyd ac a drosglwyddir fel rhan o'r cwota y mae gan y trosglwyddai hawl iddo ar gyfer y flwyddyn gwota berthnasol, ond rhaid ei drin fel pe bai'n dal i fod yn gwota nas defnyddiwyd ac ar gael lle y bo hynny'n briodol i'w ailddyrannu gan y Cynulliad Cenedlaethol yn y flwyddyn gwota honno yn unol â rheoliad 27 neu 30.

(3) Dim ond o ddechrau'r flwyddyn gwota y derbynnir yr hysbysiad trosglwyddo y mae'r trosglwyddiad cwota yn effeithiol.

(4) Ni fydd y cwota, os o gwbl, a ail-ddyrannwyd i'r trosglwyddai o dan reoliadau 27 neu 30 ar gyfer y flwyddyn gwota berthnasol (neu unrhyw flwyddyn ar ôl hynny) yn cael ei amrywio i ystyried y trosglwyddiad tan y flwyddyn gwota y derbynnir yr hysbysiad trosglwyddo.

(5) Yn y rheoliad hwn ystyr “blwyddyn gwota berthnasol” yw —

(a)yn achos hysbysiad y dylid bod wedi'i gyflwyno yn unol â rheoliad 9, y flwyddyn gwota y daw trosglwyddo'r daliad neu'r rhan o'r daliad i rym; a

(b)yn achos hysbysiad y dylid bod wedi'i gyflwyno yn unol â rheoliad 13, y flwyddyn gwota y daw trosglwyddo'r cwota i rym.
