RHAN 10Datganiadau Brys
Brigiadau clefyd mewn trydydd gwledydd
61.—(1) Pan fydd Cynulliad Cenedlaethol Cymru neu'r Asiantaeth yn cael ar ddeall fod yna mewn trydedd wlad, neu pan fydd ganddo neu ganddi seiliau rhesymol dros amau fod yno,—
(a)clefyd y cyfeirir ato yng Nghyfarwyddeb y Cyngor 82/894/EEC (ar hysbysu o glefydau anifeiliaid o fewn y Gymuned)(1); neu
(b)milhaint neu glefyd arall neu ffenomen neu amgylchiad sy'n debyg o fod yn fygythiad difrifol i iechyd anifeiliaid neu i iechyd y cyhoedd,
neu os oes unrhyw reswm difrifol arall yn ymwneud ag iechyd anifeiliaid neu iechyd y cyhoedd yn gwarantu hynny, caiff atal unrhyw gynnyrch o'r cyfan neu o unrhyw ran o'r drydedd wlad honno rhag cael ei gyflwyno i Gymru, neu caiff osod amodau ar ei gyflwyno, drwy ddatganiad.
(2) Rhaid i ddatganiad o'r fath—
(a)fod yn ysgrifenedig;
(b)cael ei gyhoeddi mewn modd y gwêl y Cynulliad Cenedlaethol neu'r Asiantaeth, yn ôl y digwydd, yn dda; a
(c)rhaid iddo bennu'r cynhyrchion a'r drydedd wlad neu'r rhan ohoni sydd o dan sylw.
(3) Rhaid i ddatganiad sy'n gosod amodau ar gyflwyno unrhyw gynnyrch o drydedd wlad neu ran ohoni i Gymru bennu'r amodau hynny.
(4) Pan fo datganiad mewn grym sy'n atal cyflwyno unrhyw gynnyrch, ni chaiff neb gyflwyno'r cynnyrch hwnnw i Gymru os yw'n tarddu o'r drydedd wlad neu'r rhan ohoni a bennir yn y datganiad.
(5) Pan fo datganiad mewn grym sy'n gosod amodau ar gyflwyno unrhyw gynnyrch, ni chaiff neb gyflwyno'r cynnyrch hwnnw i Gymru os yw'n tarddu o'r drydedd wlad neu'r rhan ohoni a bennir yn y datganiad oni bai bod y cynnyrch yn cydymffurfio â'r amodau a bennir yn y datganiad.
(6) Ceir addasu, atal neu ddirymu datganiad gan ddatganiad ysgrifenedig pellach a gyhoeddir, cyhyd ag y bo'n ymarferol, yn yr un modd ac i'r un graddau â'r datganiad gwreiddiol.
