The Learner Travel (Wales) Measure 2008 (Commencement No. 2) Order 2009

The Welsh Ministers, in exercise of the powers conferred upon them by section 28(2) of the Learner Travel (Wales) Measure 20081, make the following Order:

Title and interpretation1

The title of this Order is the Learner Travel (Wales) Measure 2008 (Commencement No. 2) Order 2009.

In this Order “the Measure” (“y Mesur”) means the Learner Travel (Wales) Measure 2008.

Appointed days2

The following provisions of the Measure come into force on 30 October 2009:

a

section 1(4)(j) (main terms used in this Measure) for the purposes of section 12;

b

section 12 (travel behaviour code);

c

section 26 (repeals) in so far as it relates to the provisions of Schedule 2 below;

d

in Schedule 2 (repeals), the repeal of paragraph 4 of Schedule 10 to the Education and Inspections Act 2006.

The following provisions of the Measure come into force on 4 January 2010:

a

section 13 (enforcement of travel behaviour code: pupils at relevant schools);

b

section 14 (enforcement of travel behaviour code: withdrawal of travel arrangements);

c

section 17(4) (co-operation: information or other assistance).

This Order brings provisions of the Learner Travel (Wales) Measure 2008 into force on 30 October 2009 and 4 January 2010.

The effect of the provisions of the Measure brought into force on 30 October 2009 is as follows:

  • Section 1(4) defines “relevant places” and paragraph (j) which refers to places where work experience is undertaken is brought into force for the purpose of section 12 so that the travel behaviour code will cover travel to such places.

  • Section 12 requires the Welsh Ministers to make a travel behaviour code setting out standards of behaviour required of learners when travelling to and from their places of learning.

  • Section 26 and Schedule 2 contain repeals.

The effect of the provisions of the Measure brought into force on 4 January 2010 is as follows:

  • Section 13 amends section 89 of the Education and Inspections Act 2006 so as to incorporate the travel behaviour code into a school’s behaviour policy.

  • Section 14 allows a local authority to withdraw transport from a learner who fails to comply with the travel behaviour code.

  • Section 17(4) requires a headteacher to assist a local authority to enforce the travel behaviour code.
