Mae Gweinidogion Cymru, drwy arfer y pwerau a roddwyd iddynt gan adran 262(2) a (3) o Ddeddf Prentisiaethau, Sgiliau, Plant a Dysgu 2009(1), yn gwneud y Gorchymyn canlynol:

Enwi a dehongli

1.—(1) Enw'r Gorchymyn hwn yw Gorchymyn Deddf Prentisiaethau, Sgiliau, Plant a Dysgu (Cychwyn Rhif 1) (Cymru) 2009.

(2) Yn y Gorchymyn hwn, ystyr “Deddf 2009” (“the 2009 Act”) yw Deddf Prentisiaethau, Sgiliau, Plant a Dysgu 2009.

Y diwrnod penodedig

2.  Daw adran 205 o Ddeddf 2009 ac Atodlen 14 iddi i rym ar 12 Ionawr 2010 o ran Cymru.

Hwn yw'r offeryn cychwyn cyntaf a wneir gan Weinidogion Cymru o dan Ddeddf Prentisiaethau, Sgiliau, Plant a Dysgu 2009 (p.22) (“Deddf 2009”).

Mae'r Gorchymyn yn dwyn i rym ar 12 Ionawr 2010 adran 205 o Ddeddf 2009 ac Atodlen 14 iddi.

Mae adran 205 o Ddeddf 2009 ac Atodlen 14 iddi yn gwneud darpariaeth o ran ysgolion sy'n peri pryder yng Nghymru ac o ran gorfodaeth ynghylch cyflogau ac amodau athrawon gan awdurdodau addysg lleol. Yn benodol mae paragraff 6 o Atodlen 14 i Ddeddf 2009 yn mewnosod adran newydd 19ZA yn Neddf Safonau a Fframwaith Ysgolion 1998 (p.31), sy'n rhoi pŵ er i Weinidogion Cymru gyfarwyddo awdurdodau addysg lleol i roi hysbysiad o rybudd i gorff llywodraethu ysgol a gynhelir mewn cysylltiad â gorchymyn o dan adran 122 o Ddeddf Addysg 2002 (cyflogau ac amodau athrawon).
