Tramgwyddau a chosbau

41.—(1) Bydd unrhyw berson sydd—

(a)yn mynd yn groes i unrhyw rai o'r darpariaethau penodedig neu yn methu â chydymffurfio â hwy;

(b)yn mynd yn groes i baragraff (3) o reoliad 26, paragraff (5) o reoliad 27 neu baragraff (4) neu (5) o reoliad 35 neu yn methu â chydymffurfio â hwy;

(c)yn mynd yn groes i unrhyw rai o'r gwaharddiadau ym mharagraff (1) o reoliad 28;

(ch)i'r graddau na fydd mynd yn groes i reoliad 29 neu fethu â chydymffurfio ag ef yn dramgwydd o dan reoliad 40, yn mynd yn groes i reoliad 29 neu'n methu â chydymffurfio ag ef; neu

(d)yn methu â chydymffurfio â hysbysiad a gyflwynir iddo o dan y Darpariaethau Mewnforio,

yn euog o dramgwydd.

(2) Yn ddarostyngedig i baragraff (3), bydd person sy'n euog o dramgwydd o dan y Rhan hon o'r Rheoliadau hyn yn agored—

(a)o'i gollfarnu'n ddiannod, i ddirwy nad yw'n fwy na'r uchafswm statudol; neu

(b)o'i gollfarnu ar dditiad, i garchariad am gyfnod nad yw'n hwy na dwy flynedd, i ddirwy neu i'r ddau.

(3) Bydd person sy'n euog o dramgwydd o dan reoliad 0 yn agored, o'i gollfarnu'n ddiannod, i ddirwy nad yw'n uwch na lefel 5 ar y raddfa safonol neu i garchariad am gyfnod nad yw'n hwy na thri mis, neu i'r ddau.
