Ceisiadau am gamau gan bartïon sydd â buddiant

29.—(1) Caiff unrhyw berson—

(a)y mae difrod amgylcheddol yn effeithio arno neu y mae'n debyg o effeithio arno, neu

(b)y mae ganddo fuddiant digonol fel arall,

hysbysu'r awdurdod gorfodi priodol o unrhyw ddifrod amgylcheddol sy'n cael ei achosi, neu sydd wedi'i achosi neu y mae bygythiad agos y byddai'n cael ei achosi.

(2) Rhaid bod y canlynol yn mynd gyda'r hysbysiad—

(a)datganiad yn esbonio'r ffordd y bydd y difrod yn effeithio ar yr hysbysydd, neu'r rheswm bod gan yr hysbysydd fuddiant digonol; a

(b)gwybodaeth sy'n ddigon i alluogi'r awdurdod gorfodi i ganfod lleoliad a natur y digwyddiad.

(3) Rhaid i'r awdurdod gorfodi ystyried yr hysbysiad a rhoi gwybod i'r hysbysydd am y camau, os oes rhai, y mae'n bwriadu eu cymryd.

(4) Cyn cymryd unrhyw benderfyniad, rhaid i'r awdurdod gorfodi, os yw'n ymarferol—

(a)hysbysu'r gweithredwr o dan sylw o'r hysbysiad a'r wybodaeth sy'n dod gyda'r hysbysiad; a

(b)gwahodd y gweithredwr hwnnw i gyflwyno sylwadau arnynt.

(5) Ni fydd paragraffau (3) a (4) yn gymwys—

(a)os nad yw'r hysbysydd yn debyg o gael ei effeithio neu os nad oes ganddo fuddiant digonol;

(b)os nad yw'r wybodaeth a ddarperir, ym marn yr awdurdod gorfodi, yn datgelu unrhyw ddifrod amgylcheddol neu fygythiad o ddifrod amgylcheddol; neu

(c)os nad yw'n ymarferol, oherwydd natur frys y sefyllfa, i'r awdurdod gorfodi gydymffurfio â'r paragraffau hynny.
