Cosbau

20.—(1) Mae person a geir yn euog o dramgwydd o dan reoliad 18 yn agored —

(a)o'i gollfarnu'n ddiannod, i ddirwy na fydd yn fwy na'r uchafswm statudol neu gyfnod o garchar na fydd yn hwy na thri mis neu'r ddau, neu

(b)o'i gollfarnu ar dditiad, i ddirwy neu gyfnod o garchar na fydd yn hwy na dwy flynedd, neu'r ddau.

(2) Pan fo corff corfforaethol yn euog o dramgwydd o dan y Rheoliadau hyn a phan brofir bod y tramgwydd wedi ei gyflawni gyda chydsyniad neu ymoddefiad, neu i'w briodoli i unrhyw esgeulustod ar ran, un o'r canlynol—

(a) unrhyw gyfarwyddwr, rheolwr, ysgrifennydd neu berson arall cyffelyb y corff corfforaethol; neu

(b)unrhyw berson a oedd yn honni gweithredu yn rhinwedd swydd o'r fath,

mae'r person hwnnw yn ogystal â'r corff corfforaethol yn euog o'r tramgwydd.

(3) At ddibenion paragraff (2) ystyr “cyfarwyddwr” (“director”), mewn perthynas â chorff corfforaethol y rheolir ei faterion gan ei aelodau, yw aelod o'r corff corfforaethol.
