The Health Professions Council has made the Health Professions Council (Registration and Fees) (Amendment) Rules 2010 which are set out in the Schedule to this Order, in exercise of the powers conferred by articles 7(1) and (2) and 41(2) of the Health Professions Order 2001(1).

In accordance with articles 7(1) and (3) and 41(3) of that Order, the Health Professions Council has consulted the Education and Training Committee and representatives of groups of persons it considers appropriate, including representatives of the groups listed in articles 7(3) and 41(3) of that Order.

In accordance with articles 41(1) and 42(1) of that Order, such Rules shall not come into force until approved by Order of the Privy Council.

Their Lordships, having considered the Rules, are pleased to, and do, approve them.

This Order may be cited as the Health Professions Council (Registration and Fees) (Amendment) Rules Order of Council 2010 and comes into force on 1st April 2010.

SCHEDULEThe Health Professions Council (Registration and Fees) (Amendment) Rules 2010

The Health Professions Council makes the following Rules in exercise of the powers conferred by articles 7(1) and (2) and 41(2) of the Health Professions Order 2001.

In accordance with articles 7(1) and (3) and 41(3) of that Order, the Health Professions Council has consulted the Education and Training Committee and representatives of groups of persons it considers appropriate, including representatives of the groups listed in articles 7(3) and 41(3) of that Order.

Citation and commencement

1.  These Rules may be cited as the Health Professions Council (Registration and Fees) (Amendment) Rules 2010 and come into force on 1st April 2010.

Amendment of the Health Professions Council (Registration and Fees) Rules 2003

2.—(1) The Health Professions Council (Registration and Fees) Rules 2003(2) are amended in accordance with the following paragraphs.

(2) In rule 10 (registration period)—

(a)after paragraph (2A)(3) insert the following paragraph—

(2B) The first registration period of a hearing aid dispenser who, on 1st April 2010, is admitted to the register by virtue of article 6(3) of the Health Professions (Hearing Aid Dispensers) Order 2010(4) (transitory and transitional provisions relating to the introduction of registration of hearing aid dispensers by the HPC), will end on 31st July 2010.;

(b)in paragraph (3), for “paragraph (2) or (2A)” substitute “paragraph (2), (2A) or (2B)”.

(3) In rule 14 (registration fee)—

(a)in paragraph (1), for “paragraph (2) and (3)” substitute “paragraphs (2) to (4)”;

(b)after paragraph (3) insert—

(4) A person—

(a)who, on 1st April 2010, is admitted to the register by virtue of article 6(3) of the Health Professions (Hearing Aid Dispensers) Order 2010 (transitory and transitional provisions relating to the introduction of registration of hearing aid dispensers by the HPC); and

(b)whose first registration period is determined in accordance with rule 10(2B),

is not liable to pay a registration fee in respect of that first registration period..

(4) In Schedule 5(5) (registration period)—

(a)after the entry in the table in respect of “Dietitians” in column 1, insert “Hearing Aid Dispensers”;

(b)opposite that entry, in column 2, insert “31st July in an even numbered year”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order approves changes to rules made by the Health Professions Council (“HPC”) in respect of the transfer of the Hearing Aid Council’s register of hearing aid dispensers to the HPC in consequence of the Health Professions (Hearing Aid Dispensers) Order 2010 (S.I.2010/233).

Rule 2 amends the Health Professions Council (Registration and Fees) Rules 2003 (scheduled to S.I.2003/1572) (“the principal Rules”). Paragraph (2) amends rule 10 of the principal Rules to ensure that the first registration period for those hearing aid dispensers who are transferred to the HPC’s register from the Hearing Aid Council’s register ends on 31st July 2010. Paragraph (3) amends rule 14 of the principal Rules to ensure that such hearing aid dispensers will not be liable to pay a fee in respect of that period. Paragraph (4) amends Schedule 5 to the principal Rules to prescribe future registration periods for hearing aid dispensers regulated by the HPC.
