The Lord Chancellor makes the following Regulations in exercise of the powers conferred by section 12(2)(g) and section 26 of the Access to Justice Act 1999(1).
1. These Regulations may be cited as the Criminal Defence Service (General) (No. 2) (Amendment) Regulations 2011 and come into force on 30th June 2011.
2. The Criminal Defence Service (General) (No. 2) Regulations 2001(2) are amended in accordance with regulation 3.
3. In regulation 3(2), after sub-paragraph (s) insert—
“(t)proceedings under sections 26, 27 and 29 of the Crime and Security Act 2010(3) relating to domestic violence protection notices and domestic violence protection orders.”

These Regulations amend the Criminal Defence Service (General) (No. 2) Regulations 2001, which govern the provision of publicly funded legal services in criminal cases. They provide that, for the purposes of legal aid, certain proceedings relating to domestic violence protection notices and domestic violence protection orders under the Crime and Security Act 2010 are to be regarded as criminal proceedings.
An impact assessment has not been prepared for this instrument as it has no impact upon businesses, charities or voluntary bodies.
1999 c. 22. Section 26 defines ‘regulations’ as regulations made by the Lord Chancellor. The reference to Lord Chancellor in section 26 was changed to the Secretary of State by S.I. 2003/1887 and changed back to the Lord Chancellor by S.I. 2005/3429.
