The Criminal Justice (Northern Ireland) Order 2008 (Commencement No. 8) Order 2015

The Department of Justice makes the following Order, in exercise of the powers conferred by Article 1(4) of the Criminal Justice (Northern Ireland) Order 2008 (1) and now vested in it (2).

Citation

1.—(1) This Order may be cited as the Criminal Justice (Northern Ireland) Order 2008 (Commencement No. 8) Order 2015.

(2) In this Order, “the 2008 Order” means the Criminal Justice (Northern Ireland) Order 2008

Appointed Day

2.  The day appointed for the coming into operation of the following provisions of the 2008 Order is 1st June 2015 —

(a)Article 19 (power to release prisoners on licence before required to do so);

(b)Article 20 (power to release certain prisoners on compassionate grounds);

(c)Article 26 except for subsection (2) (curfew condition to be included in licence under Article 19);

(d)Article 30 (recall of prisoners released early under Article 19).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into operation Articles 19, 20, 26 (partially) and 30 of the Criminal Justice (Northern Ireland) Order 2008 on 1st June 2015. These provisions provide a power to allow the release of prisoners on licence before required to do so, together with an associated power of recall, and a power to allow the release of certain prisoners on compassionate grounds.

Article 4(1) of and paragraph 32 of Schedule 1 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010/976) transferred the functions of the Secretary of State under Article 1(4) of the Criminal Justice (Northern Ireland) Order 2008 to the Department of Justice in Northern Ireland.
