Police (Insurance of Voluntary Assistants) Act 1997

1997 CHAPTER 45

An Act to provide for the insurance by police authorities and the Receiver for the Metropolitan Police District of persons providing voluntary assistance for police purposes.

[21st March 1997]

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Power of police authorities to insure voluntary assistants.E+W

(1)Section 146A of the M1Local Government Act 1972 (which treats certain other bodies as local authorities for the purposes of specified provisions of Part VII of that Act) is amended as follows.

(2)In subsection (1A)(a), for “139, 140A or 140C” there is substituted “ or 139 ”.

(3)After subsection (1A) there is inserted—

(1B)In their application by virtue of subsection (1) above to a police authority established under section 3 of the Police Act 1996, sections 140A and 140C above shall have effect as if—

(a)in the definition of “voluntary assistant” in section 140A(2), the reference to the request of the local authority or an authorised officer of the local authority included a reference to the request of a member of the police force maintained by the police authority, and

(b)section 140C(1)(a) were omitted.

(1C)For the purposes of section 140A above as it applies to a police authority established under section 3 of the M2Police Act 1996, a special constable acting as such is not to be treated as a voluntary assistant.
