The Shipbuilding Industry Board (Dissolution Provisions) Order 1971

The Secretary of State, in exercise of his powers under section 9(4) of the Shipbuilding Industry Act 1967, and all other powers in that behalf enabling him, hereby orders as follows:

Citation and commencement

1.  This Order may be cited as The Shipbuilding Industry Board (Dissolution Provisions) Order 1971 and shall come into operation on 15th December 1971.

Interpretation

2.—(1) In this Order—

the Act” means the Shipbuilding Industry Act 1967;

the Board” means the Shipbuilding Industry Board;

the dissolution year” means the period of twelve months ending with 31st March 1972;

the final period” means the period beginning with 1st April 1971 and ending with 31st December 1971.

(2) The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Report for the final period

3.—(1) The general report mentioned in section 8(1) of the Act shall not be made in respect of the dissolution year, but the Board shall on 31st December 1971 make a general report to the Secretary of State for Trade and Industry on the exercise by the Board of its functions during the final period.

(2) Section 8(2) and (3) of the Act shall apply to the report for the final period as if it were a report for a financial year, the references to a financial year in the said section 8(2) being for the purposes of such application construed as references to the final period.

Accounts for the final period

4.—(1) The Board shall keep proper accounts and other records for the final period.

(2) A statement of accounts of the Board for the final period shall—

(a)be prepared by the Secretary of State for Trade and Industry in such form as he may with the approval of the Treasury determine,

(b)be sent by the Secretary of State for Trade and Industry to the Comptroller and Auditor General not later than the end of November 1972, and

(c)thereafter be dealt with by the Comptroller and Auditor General as if it were a statement of accounts sent to him in pursuance of section 8(5) of the Act.

(3) Except to the extent provided by the foregoing paragraphs of this Article, section 8(4) and (5) of the Act shall not apply in respect of the Board's accounts, records or statement of accounts for the dissolution year.

Other provisions relating to the dissolution of the Board

5.  Every contract, agreement, licence and authority, whether written or not, and every deed, bond, instrument and document made before 31st December 1971 and still in effect on that date relating to property, rights or liabilities of the Board vested in the Secretary of State for Trade and Industry by virtue of section 9(3) of the Act shall continue in effect but subject to the following modifications so far as they are applicable—

(a)if the Board is a party thereto, the Secretary of State for Trade and Industry shall be substituted as that party;

(b)for a reference (however worded and whether express or implied) to the Board there shall as respects anything falling to be done or occurring after that date be substituted a reference to the Secretary of State for Trade and Industry;

(c)for a reference (however worded and whether express or implied) to the members or any member, or to any officer or officers of the Board there shall be substituted as respects anything done or falling to be done or occurring after that date a reference to such officer or officers as the Secretary of State shall appoint for the purpose;

(d)for a reference to the office or place of business of the Board there shall be substituted a reference to the principal offices of the Department of Trade and Industry.
