Article 12(2).

SCHEDULE 2CONSEQUENTIAL AMENDMENTS

1.  In paragraph (1) of the Schedule to the Imperial War Museum Act 1920 for the words “The Lord President” there shall be substituted “The Secretary of State for National Heritage”.

2.  In section 4(4) of the National Gallery and Tate Gallery Act 1954 for the words from “shall require the consent of” to the end there shall be substituted “shall require the consent of and be effected through the Secretary of State”.

3.  In section 8 of the Public Libraries and Museums Act 1964—

(a)in subsections (2) and (5)(d) for the word “Minister” there shall be substituted “Secretary of State”; and

(b)in subsection (7) the words from

“the Minister”meansto “Secretary of State” shall be omitted.

4.  Paragraph 17 of Schedule 4 to the Finance Act 1975 (so far as it continues to have effect) shall have effect as if—

(a)in sub-paragraph (1) for “and the Ministers agree” there were substituted “and the Secretary of State agrees”;

(b)in sub-paragraphs (3) and (4) for “the Ministers”, wherever occurring, there were substituted “the Secretary of State”; and

(c)in sub-paragraph (5) the words from “the Ministers” to “Lord President of the Council and” were omitted.

5.—(1) The National Heritage Act 1980 shall be amended as follows.

(2) In section 18(2) the definition of “the Ministers” shall be omitted and for the words—

(a)“the Ministers” in sections 2(1), 7(1) and (2), 8(1), 9(4), (5) and (6), 10(1), (2) and (3) and 12(2) and paragraphs 5(2), 6 and 7(4) of Schedule 1,

(b)“either of the Ministers” in sections 4(3), 5(3), 9(1), (3) and (4) and 16(1), (2)(e) and (5),

(c)“either Minister” in section 9(2),

(d)“the Minister” in sections 9(4) and 16(4),

(e)“the Ministers or either of them” in section 14(1),

there shall be substituted “the Secretary of State”.

(3) In section 16(3) and (4) for “Neither of the Ministers shall” there shall be substituted “The Secretary of State shall not”.

(4) In sections 2(1), 9(5) and 10(1) for “them”, “they”, “their” and “have” there shall be substituted, respectively, “him”, “he”, “his” and “has”.

(5) In section 16A(1) and (3) for the words “each of the Ministers” there shall be substituted “the Secretary of State”.

6.—(1) Section 230 of the Inheritance Tax Act 1984 (acceptance of property in satisfaction of tax) shall be amended as follows.

(2) In subsection (1) for the words “Ministers agree” there shall be substituted “Secretary of State agrees”.

(3) In subsection (3) for the word “Ministers” there shall be substituted “Secretary of State”.

(4) In subsection (4)(a) and (b) for the words “Ministers are”, in both places where they occur, there shall be substituted “Secretary of State is”.

(5) In subsection (5) the definition of the “Ministers” shall be omitted.

7.  In the Local Government Act 1985—

(a)in sections 46(1) and 47(2) and (3) for the words “the Minister” there shall be substituted “the Secretary of State”; and

(b)subsection (2) of section 46 and subsection (4) of section 47 shall be omitted.

8.—(1) The Museums and Galleries Act 1992 shall be amended as follows.

(2) In section 6(6) the words “Lord President of the Council or the” shall be omitted.

(3) In section 9—

(a)in subsection (9), the definition of “the appropriate Minister” shall be omitted; and

(b)in subsections (1) and (2) and (5) to (7) for the words “appropriate Minister”, in each place where they occur, there shall be substituted “Secretary of State”.

(4) In Schedule 8, paragraph 2 shall be omitted.

9.  In regulation 3 of the Films (Certification Regulations) 1985(1) for the words from “addressed to” to the end there shall be substituted “addressed to the Department of National Heritage”.
