Whereas the Secretary of State for Education and Skills has received a proposal from the Learning and Skills Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992(1) (“the Act”), for the dissolution under section 27 of the Act of the further education corporation known as Park College(2);
Now therefore, in exercise of the powers conferred upon him by section 27 of the Act, the Secretary of State, after consulting Park College and with the consent of the further education corporation known as Sussex Downs College(3), hereby makes the following Order:
1. This Order may be cited as the Park College (Dissolution) Order 2003 and shall come into force on 31st October 2003.
2. On 1st November 2003 Park College shall be dissolved and all of its property, rights and liabilities shall be transferred to Sussex Downs College, being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by Park College immediately before 1st November 2003 as if —
(a)the references in that section to a person to whom that section applies were to a person so employed;
(b)the references in that section to the operative date were to 1st November 2003;
(c)the references in that section to the transferor were to Park College; and
(d)the references in that section to the corporation were to Sussex Downs College.

This Order dissolves with effect from 1st November 2003 the further education corporation established to conduct Park College. It provides for the transfer of Park College’s property, rights and liabilities to Sussex Downs College and transfers Park College’s staff to Sussex Downs College without breaking the continuity of their employment.
Included under the name of Eastbourne Sixth Form College among the corporations established under s.15 of the Act by the Education (Further Education Corporations) Order 1992, S.I. 1992/2097. The College obtained permission to change its name to Park College on 1st September 1994.
Established by the Sussex Downs (Incorporation) Order 2001, S.I. 1991/2798.
