1. These Regulations may be cited as the Financial Services and Markets Act 2000 (Disclosure of Confidential Information) (Amendment) Regulations 2003, and come into force on 3rd April 2003.
2. In these Regulations—
“the Act” means the Financial Services and Markets Act 2000;
“the principal regulations” means the Financial Services and Markets Act 2000 (Disclosure of Confidential Information) Regulations 2001(3).
3. The principal regulations are amended by:
(a)inserting, after the definition of “single market directive information” in regulation 2—
““the third life insurance directive” and “the third non-life insurance directive” each has the meaning given to it by paragraph 3 of Schedule 3 to the Act;”;
(b)inserting, after regulation 9(2)—
“(2A) The references in paragraph (2) to the provisions mentioned in sub-paragraphs (a), (c), (d) and (e) are to those provisions as replaced by Directive 2000/64/EC of the European Parliament and of the Council of 7 November 2000;”.

These Regulations implement Directive 2000/64/EC of the European Parliament and of the Council of 7 November 2000, which amended Council Directives 85/611/EEC, 92/49/EEC, 92/96/EEC and 983/22/EEC with regard to the exchange of confidential information between the competent authorities of States in the European Economic Area and those of third countries. The Regulations amend regulations 2 and 9 of the principal regulations so that the amendments made by Directive 2000/64/EC are incorporated into the relevant references in the principal regulations.
