The Secretary of State for Health makes the following Order in exercise of the powers conferred by section 201 of the Health and Social Care (Community Health and Standards) Act 2003(1).
2003 c.43 (“the 2003 Act”). The “appropriate authority” for the purposes of this order is defined in section 199 of the 2003 Act.
Section 201(2) of the 2003 Act, as read with section 199(2)(c) of that Act, provides that the appropriate authority for the purpose of this order is the Secretary of State after consulting the National Assembly for Wales.
1992 c.53. Section 8 was amended by S.I. 2001/3649 and Schedule 1, paragraph 41 was substituted by the Social Security Act 1998 (c.14), Schedule 7, paragraph 121.
