The Secretary of State for Innovation, Universities and Skills makes the following Order in exercise of the powers conferred by section 32(5) of the Further Education and Training Act 2007(1):
1.—(1) This Order may be cited as the Further Education and Training Act 2007 (Commencement No. 1) (England and Wales) Order 2008.
(2) In this Order “the 2007 Act” means the Further Education and Training Act 2007.
2. The following provisions of the 2007 Act come into force on 18th April 2008:
(a)section 29 to the extent that it is not already in force;
(b)section 30 to the extent that it relates to the provisions set out in paragraphs (d) and (e);
(c)Schedule 1 to the extent that it is not already in force;
(d)in Schedule 2, the repeal of section 57(3) of the Further and Higher Education Act 1992;
(e)in Schedule 2, the repeal of paragraph 18 of Schedule 14 to the Education and Inspections Act 2006.

This Order is the first England and Wales only Commencement Order made under the Further Education and Training Act 2007 (“the 2007 Act”). The Order brings into force certain consequential amendments and repeals in the 2007 Act at the same time as sections 18(1) to (4) of that Act, which relate to Wales only, are brought into force by an Order made by Welsh Ministers.
The provisions listed in article 2 come into force on 18th April 2008.
Sections 18(1) to (4) of the 2007 Act make provision about intervention in further education institutions in Wales by amending section 57 of the Further and Higher Education Act 1992 (“the 1992 Act”). Paragraphs (a) and (c) of Article 2 commence amendments to section 57 of the 1992 Act consequent upon the coming into force of sections 18(1) to (4).
Paragraphs (b), (d) and (e) of this Order commence the repeal of subsection (3) of section 57 of the 1992 Act and the repeal of paragraph 18 of Schedule 14 to the Education and Inspections Act 2006, both being provisions which are rendered obsolete by other amendments made by sections 18(1) to (4) of the 2007 Act to section 57 of the 1992 Act.
