The Queen’s Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by sections 60 (other than sub-section (3)(r)) and 102 of and Schedule 13 to the Civil Aviation Act 1982(1) is pleased, by and with the advice of Her Privy Council, to order as follows.

Citation and commencement

1.  This Order may be cited as the Air Navigation (Amendment) Order 2008 and comes into force on 6th August 2008.

Amendment of the Air Navigation Order 2005

2.  The Air Navigation Order 2005(2) is amended by inserting after article 167(1)(b)—

(c)the competent authority of the United Kingdom for the purposes of Annex III of Council Regulation (EEC) No 3922/91 of 16th December 1991 on the harmonisation of technical requirements and administrative procedures in the field of civil aviation(3)..

EXPLANATORY NOTE

(This note is not part of the Order)

The Civil Aviation Authority is the competent authority for the purposes of Annex III of Council Regulation (EEC) No 3922/91 (OJ No. L 373, 31.12.91, p.4. Annex III was inserted by Council Regulation (EC) No 8/08 of 11th December 2007, OJ No. L 10, 12.1.08, p.1).

Annex III contains operating rules for commercial air transport aeroplanes including provision for the issue or air operator’s certificates to commercial air transport operators.

An Impact Assessment has not been provided for this Instrument as no impact on the private or voluntary sectors is foreseen.

1982 c.16, sections 60 and 61 have been amended by the Airports Act 1986 (c.31) Schedule 6 Part 11, and section 60 was further amended by the Aviation and Maritime Security Act 1990 (c.31), section 47 and Schedule 4 and Schedule 13 has been amended by the Energy Act 2004 c.20, section 101.

Annex III was inserted by Commission Regulation (EC) No 8/2008 of 11th December 2007 amending Council Regulation (EEC) No 3922/91 as regards common technical requirements and administrative procedures applicable to commercial transportation by aeroplane, OJ No. L 10, 12.1.08, p.1. Council Regulation 3922/91 applies throughout the area of the EEA by virtue of the amendment of the EEA Agreement (Cm 2073 and 2183) by the Decision of the EEA Joint Committee No 7/94 of 21.3.94 (OJ No. L160, 28.6.94, p.1).
