The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 18(2), 77(1), (2) and (6), 272(7) and (8) and 273(1) of, and paragraph 13(1) of Schedule 3 to, the National Health Service Act 2006(1).
The Secretary of State considers that designation of the Blackburn with Darwen Primary Care Trust as a Care Trust would be likely to promote the effective exercise by that trust of prescribed health-related functions of a local authority as specified in section 77(1)(b) of the Act(2).
The Secretary of State makes this Order following an application made to the Secretary of State under section 77(2) of the Act and following the consultation prescribed under section 18(5) of the Act(3).
The exercise of functions specified in section 77(1)(b) is the exercise of prescribed health-related functions of a local authority in conjunction with prescribed NHS functions; the functions are prescribed by the NHS Bodies and Local Authorities Partnership Arrangements Regulations 2000 (S.I. 2000/617).
