The Secretary of State makes the following Order in exercise of the powers conferred by section 40(1) and (2) of the Horserace Betting and Olympic Lottery Act 2004(1):
1. This Order may be cited as The Horserace Betting and Olympic Lottery Act 2004 (Commencement No. 4) Order 2011.
2. The following provisions of the Horserace Betting and Olympic Lottery Act 2004 shall come into force on 25th February 2011:
sections 1, 2, 3, 4, 5, 6, 7, 8;
subsections (1), (4), (6) and (7) of section 9;
section 12 for the purposes of the above sections and subsections.

This Order brings into force certain provisions of Part 1 of the Horserace Betting and Olympic Lottery Act 2004 (Sale of the Tote) on 25th February 2011. Sections 1 to 4 of that Act provide for the dissolution of the Horserace Totalisator Board (the Tote) and the transfer of its property, rights and liabilities to the successor company. Sections 5 to 7 deal with the operation of the successor company. Section 8 and subsections (1), (4), (6) and (7) of section 9 give the Gambling Commission (as the Gaming Board’s successor) power, if the Secretary of State so requires, to issue the successor company with an exclusive licence to carry on pool betting in connection with certain horse races. Section 12 concerns the interpretation of Part 1 of the Act. This Order commences these sections to enable the sale of the Tote’s businesses.
