Risg difrifol i iechyd anifeiliaid neu iechyd y cyhoedd

33.—(1) Pan fo'r Cynulliad neu'r Asiantaeth yn cael ar ddeall, neu pan fo ganddo neu ganddi sail resymol dros amau, bod bwyd neu fwyd anifeiliaid wedi'i gyflwyno neu y gall gael ei gyflwyno o drydedd wlad a'i fod yn debyg o fod yn risg difrifol i iechyd anifeiliaid neu iechyd y cyhoedd, caiff y naill neu'r llall ohonynt drwy ddatganiad ysgrifenedig atal unrhyw gynnyrch rhag cael ei gyflwyno i Gymru o'r drydedd wlad gyfan honno neu unrhyw ran ohoni, neu osod amodau ar ei gyflwyno i Gymru.

(2) Bydd datganiad o'r fath yn ysgrifenedig ac fe'i cyhoeddir yn y modd y gwêl y Cynulliad neu'r Asiantaeth, yn ôl y digwydd, yn dda a bydd yn pennu'r cynhyrchion a'r drydedd wlad neu'r rhan ohoni sydd o dan sylw.

(3) Rhaid i ddatganiad sy'n gosod amodau ar gyflwyno unrhyw gynnyrch o drydedd wlad neu ran ohoni bennu'r amodau hynny.

(4) Pan fo datganiad mewn grym sy'n atal unrhyw gynnyrch rhag cael ei gyflwyno i Gymru, ni chaiff unrhyw berson gyflwyno'r cynnyrch hwnnw i Gymru os yw'n tarddu o'r drydedd wlad neu o'r rhan ohoni a bennir yn y datganiad.

(5) Pan fo datganiad mewn grym sy'n gosod amodau ar gyflwyno unrhyw gynnyrch, ni chaiff unrhyw berson gyflwyno'r cynnyrch hwnnw i Gymru os yw'n tarddu o'r drydedd wlad neu'r rhan ohoni a bennir yn y datganiad oni bai bod y cynnyrch yn cydymffurfio â'r amodau a bennir yn y datganiad.

(6) Caiff datganiad gael ei addasu, ei atal neu ei dirymu gan ddatganiad ysgrifenedig pellach a gyhoeddir, cyhyd ag y bo'n ymarferol, yn yr un modd ac i'r un graddau â'r datganiad gwreiddiol.
