Gorbori

8.—(1) Yn ddarostyngedig i baragraff (2), os bydd y Bwrdd o'r farn bod unrhyw barsel o dir yn cael ei orbori, caiff gyflwyno hysbysiad ysgrifenedig i'r meddiannydd gan bennu uchafswm yr anifeiliaid a all gael eu pori a'u cadw ar y parsel hwnnw yn y flwyddyn galendr ganlynol.

(2) Pennir yr uchafswm y cyfeirir ato ym mharagraff (1) drwy gymryd i ystyriaeth yr amgylchiadau hynny a bennir yn yr hysbysiad.

(3) Os yw hysbysiad mewn perthynas â pharsel o dir wedi'i gyflwyno gan y Bwrdd o'r blaen o dan baragraff (1) neu gan y Cynulliad Cenedlaethol dan unrhyw ddarpariaeth a bennir ym mharagraff (5), caiff y Bwrdd gyflwyno hysbysiad pellach o dan baragraff (1) mewn perthynas ag ef heb iddo fod o'r farn ei fod yn cael ei orbori.

(4) Os yw hysbysiad mewn perthynas â pharsel o dir wedi'i gyflwyno gan y Bwrdd o dan baragraff (1) neu (3) neu gan y Cynulliad Cenedlaethol dan unrhyw ddarpariaeth a bennir ym mharagraff (5), rhaid i'r Bwrdd beidio â thalu, neu os yw eisoes wedi'i dalu, adennill, unrhyw bremiwm cigydda sy'n daladwy neu a dalwyd ar y nifer hwnnw o anifeiliaid premiwm a gafodd eu pori a'u cadw yno yn y flwyddyn galendr y cyhoeddwyd yr hysbysiad hwnnw yn ei gylch, a fyddai, o'u hychwanegu at y nifer o anifeiliaid arall (gan gynnwys anifeiliaid premiwm) a borwyd ac a gynhaliwyd yno yn y flwyddyn honno, yn golygu eu bod yn mynd ymhellach na'r uchafrif anifeiliaid a bennwyd yn yr hysbysiad.

(5) Y darpariaethau y cyfeirir atynt ym mharagraffau (3) a (4) yw'r canlynol—

(a)rheoliad 11 o Reoliadau Cynllun Premiwn Arbennig Eidion 1996;

(b)rheoliad 3A o Reoliadau Premiwm Buchod Sugno 1993(1);

(c)rheoliad 3A o Reoliadau Premiwm Blynyddol Defaid 1992(2);

(6) Caiff y Bwrdd beidio a thalu, neu adennill, premiwm cigydda os yw'n fodlon bod unrhyw amod arall yn yr hysbysiad wedi'i dorri.
