Darpariaethau gwybodaeth

21.—(1) Yn ddarostyngedig i baragraffau (2) a (3), ni chaiff unrhyw berson gyhoeddi neu ddatgelu unrhyw wybodaeth gyfrinachol a gafodd y person hwnnw, cyn i'r Rheoliadau hyn ddod i rym, wrth iddo gyflawni ei swyddogaethau o dan reoliad 11 o Reoliadau Porthiant 2000 (“Feeding Stuffs Regulations 2000”) heb gydsyniad blaenorol ysgrifenedig—

(a)y person a wnaeth gais, yn unol â'r rheoliad hwnnw, am awdurdodiad gan y Gymuned, neu yn ôl y digwydd, am ddefnydd newydd, o'r ychwanegyn o dan sylw, neu

(b)aseinai neu olynydd perchenogaeth y person hwnnw i'r wybodaeth gyfrinachol.

(2) Nid oes dim ym mharagraff (1) yn cyfyngu ar gyhoeddi neu ddatgelu'r wybodaeth honno at ddibenion arfer swyddogaethau o dan y rheoliad hwnnw.

(3) Nid oes dim ym mharagraff (1) yn atal cyhoeddi neu ddatgelu gwybodaeth gyfrinachol o fath a bennir yn Erthygl 7(2) o'r Gyfarwyddeb Ychwanegion.

(4) Yn y rheoliad hwn, ystyr “gwybodaeth gyfrinachol” (“confidential information”) yw gwybodaeth o'r fath a bennir yn Erthygl 7(1) o'r Cyfarwyddeb Ychwanegion ac mae i “ychwanegyn” (“additive”) yr ystyr a roddir yn Erthygl 2 o'r Gyfarwyddeb honno.

(5) Mae cyhoeddi neu ddatgelu yn groes i baragraff (1) yn dwyn cosb fel pe bai'n ddatgelu a waherddir gan adran 83 o'r Ddeddf.
